Guidelines for Uniformity and Easy Registration of Property

Property registration has become easy and there will be uniformity across the state. The discretionary powers given to sub-registrar have been removed. New guidelines have been issued which contains information on documents required for registration. Earlier property registration was one of the complex tasks but now the process has been made uniform and simple.




Revenue department has issued guidelines to sub-registrar on the documents required for registration of property. Guidelines include instructions from Karnataka Information Commission to the Inspector General of Stamps and Registrations and the Revenue Department. Guidelines will help citizens to register property easily preventing haphazard growth of cities. Bringing uniformity in registration process puts a check on registration of properties without proper documents.

Documents required for registration:
The property coming under jurisdiction of BBMP (Bruhat Bangaluru Mahanagara Palike), gram panchayat, town panchayat, municipalities and municipal councils or any corporation in the state requires six important documents. The lists of documents required are as follows.
1. Khata and tax determination receipt issued by BBMP or corporation,
2. An affidavit,
3. Sanction plan or Conversion certificate, if the property is on converted land,
4. Title deed or allotment order or possession certificate or sales document, if property is given by government department or agencies,
5. PAN issued by Income Tax Department or Form 60 and 61 if the property values more than 5 lakhs, and
6. Declaration in form 1 under the Karnataka Stamps Rules 1977. (Prevention of Undervaluation of property).

Documents required for registration of Agricultural Lands are as follows:
1. An Affidavit,
2. Declaration in form 1 under the Karnataka Stamps Rules 1977. (Prevention of Undervaluation of property),
3. RTC,
4. Declaration under Section 81-A of the Land Reforms Act,
5. Survey sketch of the land,
6. PAN issued by Income Tax Department, and
7. No Objection Certificate (NOC) from the appropriate authority under Section 6 of Karnataka SCs/STs Act, 1978 that prohibits sale of certain lands have to be submitted.

Summary:
Uniform procedure across State. Discretionary powers of sub-registrars removed. Documents required for the purpose have been listed
Now registration of property is easy and there will be uniformity across the state. The new guidelines prevent harassing of citizens demanding for different documents while registering the property. Also the property without proper documents cannot be registered and will prevent haphazard growth of cities.

    This process is supposed to be “EASY” ?
    Just publishing a list of documents doesn’t make the process easy. It is exactly these documents that drain the time and energy as we have to run from pillar to post (or bribe the officials) to get them. I have been trying to get my BESCOM meter transferred from builder’s name to my name and still have not been able to do so coz the “Easy” process requires a ton of documents that I still do not have.

      For the Property registration you need to sumbit Afficavit, Title of the Documents and Sale Deed Draft and other documents before the Sub-Registrar Office, its depends upon the which type property your going to purchase.

        1. Do I need to obtain in a written paper or stamp paper the amount of money I had given to land developer.
        2. In case reqd. will the developer sign or
        3. Since I received my registration papers can I leave the issue over.

    Has it not now been made quite clear by the executive that in Karnataka, for registration of a deed of conveyance of an apartment, stamp duty should not but be paid only on the higher of the sales consideration or guideline value?

    Do not the registering authorities now scrupulously follow the correct position in law /practice as aforesaid?

      In karnataka, there is only one way to register. its not like what you think of, the amount what your going to mention in the sale deed, for that amount you need to pay the stamp duty as well as registration fee either you can mentin higher value than the guideline of the property not lower than the guideline value, kindly make sure that the property is not under valued.

        My poser was on a limited but specific point raised wrt the facts to be briefly stated thus: It pertains to apartments still to be completed. In the Sale Deed the actual consideration will be specified. That will be far higher than the so-called guideline value. Some of the buyers/ their lawyers are of the view (in my opinion, wrongly so) that as there is a prescribed guideline value, that is open/permissible to be adopted for paying stamp duty, albeit the sale deed value (which should/would normally be taken to represent the ‘market value’) being higher than the guideline value.

        As one ought to be aware (see the information/ official clarifications, etc. available in public domain – the connected websites), though controversies seem to persist even now, the view of the authorities do not favor any such stand as sought to be canvassed by the buyers/their lawyers as aforesaid.

        Hence my poser to you, for having my own opinion cleared.

        I hope the purport of my poser is now quite clear.

        Also, hopefully, will leave the lady – who has chosen to intervene, though in an unprecedented manner, and to post her own unsolicited comment, – less confused.

          well swaminanthan what you interpret as intervene was only clarification to your confusing query. you option cannot be the option of all members. again putting the market value or the real consideration in the deeds is ones own discretion and as far as sale of apartments i advice govt value to be put for registration.

    v swaminathan your question is confusing. you need to precisely state your question . well stamp duty has to be paid on the ocnsideration that you highlight on your sale deed. in case you show guideline value then you need to pay thr stamp duty ofr that but if you opt for showing higher sale consideartion then you need to pay on that amount

        We purchased a flat jointly with my wife in DumDum,Kolkata,WB and the registration on both name had on 13/08/2009. We also took jointly a Home Loan in SBI,Kolkata about 15 lacks and the deed is now under SBI bank. EMI of the bank started on March 2009.
        Now I want to register the flat in my wife’s name only.
        What is the process to do that? Is there any effect on Bank Loan?
        Please let me know as early as possible.

  10. sir, i want to know that i have property in bhiwadi rajasthan and i want to registered it, in bhiwadi, so what document will required ? and how much i have to pay for registration? the flat cost is 11 lakhs, and now i m residing in banglore did i have to go to bhiwadi for regestration or any other process for registration without going there.

    You can sell the property by nominating one person to sell the property there only, you need not go for it, It means you need to execute the Special Power of Attorney or General Power of Attorney in favour some body in your family.

    4. Encumbrance Certificate
    5. any other documents relating to the property

    mr nagendra, suraj did not say he wants to sell probably he has a property and has not registered in his name . well suraj you need to be specific whether you want to sell or you want to buy. Suraj registration fees is paid under the registration act and the registration fees differs from state to state. For example release wihtin the family in karnataka is 1000 whereas the same is not in kerala. So you will have to find the local registration fees to know how much you need to pay for 11 lakhs.

      If the property which is having genuine endorsement from the BBMP, then you can buy that property, if it is possible to handover the documents to us, then only we can able to advice you in a better way for that property.

    I like to know from anyone who has information on how site are formed and registered to bogus members by Vishwar Bharathi Housing Cooperative Society (VBHSC) without a sanctioned plan from BDA or Conversion cSanction plan or Conversion certificate, if the property is on converted landertificate. In fact , VBHCS registered a site to me in 2003 showing me plan which was purportedto be approved by BDA. But, sub-registrar office now tells me that it does not have a sanctioned plan with it when it did register sales deed. How is possible and what is the remedy I can seek now and from where?

    I am buying a ground floor flat in Delhi .Landlord has 3 floors in his home . He has already sold first floor from his home . Now I am going to purchase ground floor .

    Now my question is, after selling the ground floor to me :-
    1) Is there will be any change in landlord’s old registry papers ( mentioning the sale of ground floor . Because xerox copy of registry papers landlord has shown to me , doesn’t contain any description of sale of first floor ) ?

    2) After sale of any house / flat , old registry papers are given to new buyer or they are kept in registrar office or old landlord keeps old papers ?

    can sub registrar refuse to register if deviation is found in the sanction plan in a flat.. ie., if sanction is for 400 sq ft and constructed is 800 sq ft ? then why BBMP has kept quite until the construction.. who decides on the deviation on sanction plan… i am yet to register my flat.. i am aware that if not all most apartments have deviated the sanction plan .. but how did they got registered ? sub registrar is expecting huge bribe… what is the way out..my money is struck…kindly advice..

    I have a query. I had sold a property before and have declared the capital gains. I also got a new property (a resale on a non-registered property) that covers the capital gain portion and I have an ‘agreement for sale’ with the seller. Builder is refusing to register at the amount I mentioned (i.e the amount more than capital gains tax) and the builder is saying that one can register the property on undivided share. If this valuation comes less than the capital gains then,

    1) Do I still have a gain and need to pay tax.
    2) Or Can I use the sale document with the buyer as a supporting doc for my tax filings.

    I am having a house in Bangalore – Prakash Nagar and planning to sell it as one prospective buyer has approached me. I am having all the documents on my name and khata paid upto date. The buyer is insisting for BDA sale deed as I do not have that since when I registered it was CITB and CITB has been taken over by BMP/BDA which I am not aware.

    Please advice what I should .
