Renting is one of the sources of income for landlord and a solution for people who shifted to new location or family who don’t have enough money to owe an own house. Earlier tenants were exploited by landlords and in some case landlords are in trouble by providing their property to tenants who make nuisance or mess in building.
Rental agreement is agreement or mutual understanding between tenant and landlord on the terms and condition for lending a property for rent. In a rental agreement landlord will explain terms and conditions and prepare a written document where tenant and landlord will sign and a copy of the same will be handover to tenant. Making agreement in written is good for future purpose and if any change in condition it will be informed with prior notice of 30 days.
Important sections to cover in rental agreements
Rental agreements need to be written in a stamp paper and signed by tenant and landlords. Here are some common agreements or conditions that need to be included in an agreement for keeping property in good condition and make prompt pay of monthly rents.
- List of things: List of things is facilities or appliance provided by a landlord to tenants along with property for rent. Things include appliances like number of fan, geyser, light fittings and so on. These things cannot be taken with them by tenant when leaving property.
- Due date: The date for paying each month’s rent and the date when it is considered as late payment. If there is any charge for late payment and time to take action when continues default.
- Right to enter: The date or time from which property is let to rent. Tenant need to inform prior to landlord from when he starts using the property or building.
- Garbage: Need to specify orally or in written where to keep garbage for collection by garbage collector and how to dispose garbage. The improper dispose of garbage creates problem for fellow tenants and for it become health problem
- Policies: Policies regarding parking vehicle and whether pets are allowed in the premises or not. These have to be clearly mentioned in rental agreement than become problem in future.
- Notice period: Tenant should give at least one month notice prior to leaving and demanding for deposit. Landlord must ask a reasonable time for giving back deposit.
- Restoration: Conditions which need to restore the dwelling place or building. It includes repairs and paintings, plumbing if required and so on.
A landlord should ask identity of person who are using the property. Remember not to give your property or building for people who have criminal background or do not allow continuing if you doubt on their action or if they involved in some anti-social activities.

Hi, i need an immediate help. Me and my 4 collegues were planned to take a house for rent. we took and signed the agreement for the house of rent 3200 and the advance of 30000, for 11 months. after 2 months stayed, 2 of my collegues want to change the house.Me and my another collegue cannot pay the rent of 3200 instead of 4. So we said we will reduce your upcomming rent from your advance. Now they are going to split the agreement into 2, to save their advance. what can we do now? we cant vacate the house unless we get our advance. can the spliting of agreement done? what are its impacts?
Hi i stayed in a 2bhk house for four months paying rent of 12000/- and deposit of 70000/- wen i shifted to house 4 months back the house was not in tentable condition! Bathrooms washbasins cannot be used, house was not pAinted, washbasin of kitchen leaks and floods whole kitchen everytime! Bathrooms are dirty . And the way for other bathroom is garbage dump of people residing above.
I was promised that it will be painted and repaired within 15days of my occupancy. But nothing was repaired till three months . The land lord stays outside and kept a caretaker who deals with everything. In the fourth month we cut 2000/- in rent and told the care taker to repair everything and he asked us to vacate house. In the next month we asked him about deposit and he said pay the rent. We said we wish to leave the house and kindly refund our deposit amount. Then he says pay the rent deposit will be settled later. We said we are not interested in living here. Then he got raudy and said u wont get any money. We tried to contact the land lord but he is alws non responsive finally once we contacted and he said he will cut three months rent becuz we are leaving before 11 months. And he is not ready to repair anything. Kindly help anyone. Where i should apply to get my deposit back . Is there a consumer forum in bangalore .

I intend to give an apartment on rent to four students for a period of 11 months. I will do a lease agreement and get it registered. How the Lessee would be defined when there are four tenenats and what should be the matter of agreement.
General Advise: Rent agreement of less than 12 months are optional for registration. As per Registeration Act. Please consult local lawyer as well.
I am going to rent a 2BHK in the Sanpada-Vashi area in Navi Mumbai and I have been told that the cost of the document and the police NOC are to be borne by me (the owner will not pay) – That is fair enough. I wanted to know two things:
1. What is this police NOC. Earlier I rented and lived in Hyderabad for few years and all we did was a rental agreement. Why is this police NOC required? (Some say bachelors need police NOC to live in a society. Is that true? [I am a bachelor]).
2. The broker who is doing the documentation and the police NOC is asking Rs. 10,000.00 (Not brokerage, but document preparation charges). I think I am being cheated.
