It is very cumbersome to handle the various different certificates and documents required to proceed if you are either buying or selling property. We attempt to demystify the most prominent of these, Khata.
What is a Khata?
It literally means an account, this Khata is an account of a person who has property in the city. It is an account of assessment of property owners within BBMP (Bruhat Bengaluru Mahanagara Palike) jurisdiction. Khata is important when you apply for any license of building or for trade, applying for loan from any banks or financial institution.It consists all the details of property like name of owner, size of buildings, location of property and all other details that helps to file property tax.
There are two things in a Khata:
a) Khata Certificate
b) Khata Extract.
a) Khata Certificate
A BBMP Khata certificate is required for two major purposes:
1. For registration of a new property,
2. For transfer of any property.For applying khata certificate, the owner of property has to give letter of requisition along with details and receipts of tax paid (latest) to Assistant officer for the sub-division or range. The fee for certificate is RS.25/- per property.Khata Certificate is obtained for any new registration after paying the tax. The certificate is issued saying that a particular property No ‘XYZ’ stands in the name of person A. This certificate is required to apply for water connection, electricity connection, trade license and building license. The Khata certificate is given only to the owner of the property or to his family members. No one else can take it on his behalf. It takes maximum of One week to get the certificate. (When a transaction takes place both the seller and the buyer have to inform the BBMP within three months of the transaction. In case of death of either party, within one year.)
b) Khata Extract
Khata Extract is getting details from the assessment register. The extract is required to get trade license, or to buy a particular property. It has the details of the property like the name, size of the property, use of the property (commercial purpose, residential), annual value, when assessed last.For getting a khata extract, owner of property has to give letter of requisition with property location and details. The fee is Rs.100/- per extract for a period of 5 years of the property.
Eligible for obtaining Khata
All property owners/holders who hold property within the BBMP jurisdiction are eligible to obtain a Khata. Obtaining a khata does not confer ownership of property but confers the person who liable to pay property tax. Property tax can be paid by property owners/holders who may or may not have Khata but it is important when you apply for any license of building or for trade, applying for loan from any banks.
Document required for Khata registration
For applying Khata registration, you needed to enclose following documents along with registration form.
1. Documents required for property of land type- Revenue Pockets / BDA Reconveyed areas / Gramathana :
i. Title deed (Reconveyed documents from BDA in case of BDA Reconveyed areas)
ii. Tax paid receipts and Khatha details
iii. Sketch of your property showing its boundaries and location of site
iv. Improvement Charges
v. National Saving Certificates for Rs.200/-
vi. Encumbrance certificate for vacant sites
vii. Flow chart of title
2. Documents required for property of land type- BDA / KHB Layout
i. Title deed or Possession certificate
ii. National Saving Certificates for Rs.200/-
iii. Encumbrance certificate for vacant sites
iv. Flow chart of title.
What is Khata Transfer?
Khata transfer is required when the ownership of property is transferred from one person to another for any reason like sale of property, gift, will or in case of death of property owner and so on. The application for Khata transfer is same that for registration and the documents needed along with application are following:
1. Title deed
2. Tax paid receipts and Khata details
3. Paid up improvement charges receipt
4. National Saving Certificates for Rs.200/-
5. Death certificate of owner (in case of application due to death own property owner)
6. Affidavit declaring the applicants is legal heirs of the deceased khatedar.
What is Bifurcation of Khata?
Bifurcation of Khata is modifying two or more Khata into one or dividing one Khata into two or more Khata. Application form for bifurcation of Khata is same that applied for registration
Procedure for Registering, transferring and modifying Khata
- Obtain Notarized copy of your sale deed: There are number of notaries in Bangalore where you can get your work done at reasonable fees and the entire sales deed is notarized for charge of Rs 80-100. Normally agents charge good commission per page and charge for get your work done rises to Rs 200 and above.
- Encumbrance certificate (EC): Get EC for your property and one has to carry copy of sales deed for getting EC. Normally EC is handled within 7 working days.
- Application for Khata: Obtain Khata registration form for applying for Khata. Application is same applying for Registration, Transfer and modification of Khata. It is available either online or at any BBMP office. Application costs Rs10.
- Enclosure of documents: While applying for Khata, enclose the essential documents and fill up the necessary information in the application form. Submit the filled registration form at BBMP office and get sealed acknowledgement for the same. Acknowledgement is one of the sheets in the application.
- Check the status of your application: Visit once in 15 days and check the status of your application. Remember any documents demanded by the BBMP office, over and above those listed above, and validated by the RTI is illegal to ask and just a means to harass you and tire you down.
- Seek Information: After 2 months if there is still no activity then file the RTI to seek information on status of khata registration.
- Assessment of Property by Officials: The BBMP Revenue Incharge and Assistant Revenue Officer personally visits the property to assess the property. Please note that if the property is assessed as commercial read as ‘Rented Out’ the property tax is twice the normal property tax.
- Khata Registration fee: After the property is assessed BBMP formally communicates this mentioning the property dimensions (in sq feet), its value as per BBMP assessment and the tax liability thereon. One is also provided with a notice mentioning the same and informing you to pay the Khata Registration fee – 2% of the property values as Khata Registration fee (this is 2% of the value mentioned in the Sale deed). Once you pay the Khata Registration fee, in about 1-2 weeks, one receives the notice for paying the pending property tax. Without this the Khata Extract will not be issued in your name. But if you have reached this point it means Khata has been technically registered on your name.
Fee for Khata related processes
Application for Katha registration, Katha transfer can be applied in the form “Application for Registration/ Modification of Khata”. You can also download the form from BBMP website and link is as follows-

Khata certificate is often misunderstood with title deed. Title deed is the deed agreed between a buyer and seller during the transfer of property and Khata is account of assessment of property. Khata does not confirm ownership of property but assessment of property for the payment of tax. The property owner can pay their property tax in two installments but improvement expense must be paid in lump sum.
You can apply for Registration, transfer or modification of khata in Assistant revenue officer for the sub-division or range between 10 am to 1:30 pm and 2:30 pm to 5:30 pm on all working days. BBMP offers Sarala Khata Scheme Book which is available in major citizens’ service center on payment of Rs.20/-. This book contains guidelines and details for filing application for khata. This is actually a Agricutural land and they converted to non-Agriculturer and they divided the place into plots and constructed the roads(they made it like a layout).Now they are selling individual plots.

Thanks a lot for such an informative article. I have one question regarding the betterment charges (or the improvement charges). Could you please clarify me what exactly is that. My builder claims that the land of the apartment (Vanshee Solitaire Chinnapanahalli) comes under the Gramtana, so no betterment charges need to be paid. But in the article you have said the other way.
Is betterment charges different from the improvement charges ? It will be great if you could throw some light on this.

@S.Ravi: Khat transfer of Flats having Undivided interest in land is governed by the Apartment Ownership Act, and that it is only after the registration of the Deed of Declaration along with the Bye-Laws of the Flat owners Association that the Flats can be assigned with Numbers/ Sub Numbers and Khata transfered to the respective Flat owners Name.
@Venkat : A person need not be present in person for Khata Transfer, but the same could be executed by any Attorney Holder, the Power of Attorney Cane be made and sent to the person who could get the same Attested before a Notary Public in the Area or Before the Indian High Commission/ or Consulate General

We are flat owners. We had approached the panchayat office for khatha transfer. We are advised to contact builder for bifurcation/subdivision of main khatha which is issued for the whole land. I have few queries:
1. Is it mandatory that khata can be transferred only after the bifurcation/subdivision?
2. Generally, who is supposed to initiate for bifurcation/subdivision of Khatha, builder or flat owners?
3. What is the procedure for bifurcation of khatha?
4. From builder side, they are asking us to pay bribe amount to the govt officials? So what would be the approximate estimate of cost for transfer (with and without bribe)? – We are all the legal documents. nothing is illegal, Still the official want bribe. some of us had checked with the officials personally.

The Answer for your question is that Bifurcation of khata of any Apartment building can only be effected upon registration of the deed of declaration, which includes the Registration of the Apartment owners assocation and its Bye- law, which interalia means that you have submitted yourself to the Karnataka Government Apartment ownership Act., of course little miscellaneous expenses are required to be spent for the same, it is not necessary thast the Owner of the building is required for the change of Khata, however the Joint owners of the Apartment or any individual owner can have the deed of declaration registered and thereafter make representation for khata transfer. It is the revenue officer, who deals with the khata transfer you need to meet him and discuss the issue, it is immaterial even if all the documents are perfect and unquestionable, certain miscellaneous expenses does involve.

I thinking of buying a flat in outter ring road(near marathahali); The builder said he has approval from CMC but not from BBMP as the area recently came under BBMP. And I heard there is recently a rule came in and it requires BBMP khata for registration without it registration cant happen.

Hi,
The builder has not paid any betterment charges to the BBMP/CMC for a newly constructed apartment . He plans to collect the same from all the flat owners now as it is required for khata transfer.
In the JDA builder & landowner it was mentioned that “all betterment taxes should be paid and construction to be started by the builder” and also as per the sale deed(which is a supplementary agreement based on the above JDA) the builder has mentioned that he has paid all “property taxes & other charges whatsoever” . In this context Who is liable to pay the betterment charges. Is it the builder or the flat-owner?
Normally when should the betterment charges be paid? Is it before construction or after construction?

Normally After the completion of the Project only better chagres should be paid, some of the cases Bulders already paid the betterment then these is no need to pay but in some of the cases if Builder not paid then it should be paid based on the agreement not on the Sale Deed, If it is not mentined any where in the Agreement or Sale Deed then problem will arises to the Purchaser not to the Builders. The BBMP will ask the new owner to pay as per the rules and regulations so mutually discuss with the builder and settle the matter amicably

Hi,
We have bought a flat in KR Puram, and the flat is ready for possession and registration. But the builder is delaying the registration, saying that after 1st week of june, there has a new rule come into effect. According to that, Builder has to get a ‘Khata’ on his name for each flat, before doing the registration. And for doing this he needs 2-3 weeks. I am not sure if this is indeed right. Can somebody throw some light on this.

A per new rules and regulations from the Govt., builder has to obtain the Khata Certificate for the whole property not indiually, because there is problem with Builders with Govt (Betterment Chagres) . After obtaining the khata for the whole property, it can splitted to the subsequent owners.

Calculation for registration will in two ways.
1. As per the guideline value of the Property *6.7% is the Stamp Duty and 1% is the regitration fee
Example 400000*6.7%= 26800/- is the Stamp Duty
400000*1% = 4000/- is the Registration fee
and some 1500/- is the Scanning fee.
2. As per the amount paid by you to the property *6.7 is the Stamp duty and 1% is the registration fee
and some amount is the scanning fee

Panchayat area, the owner is having panchayat khatta and he didn’t receive the BBMP khatta yet.
Please clarify my doubts on this regard,
1) If I go for a bank loan to purchase, can I get loan with the old khatta(panchayat) ?
2) During the registration, the registrar will question about lattest khatta is it ?
3) Is it possible to register the property with old khatta(panchayat) ? If yes, how the khatta transfer will be done.

Its depends upon the Banks, particularly natinalised Banks will not entertain the such loan application, those properties dont have BBMP khata should get the BBMP khata otherwise registrations will not happens after 01.04.2009 as per the new regulations from the Govt.
Its not called illegal, still you can buy the property, all you need to do is enter into an agreement now and after getting the BBMP khata go for rigistration

Hi Vinay, I was in a similiar position to get the Khata from BBMP after my property came under BBMP, earlier it was under Gram Panchayat. I had an existing loan on this property and wanted to switch over but the new bank needed Khata from BBMP. After checking I found that BBMP can issue an Endorsement which basically tells that this is a BBMP property. and I was able to get the loan based on the Endorsement copy from BBMP. This was not free, I had to pay a BOMB to get this copy.

He has said that registrations are happening without Khata. He also does not have occupancy certificate. They have mentioned that the loan is approved by a nationalised bank.

I am planning to buy a flat @ Brigade metropolis from a seller who has registered the property but has not recieved the khata from the builder.
I would like to know the procedure that I would need to follow to get the property registered in my name. Would it be possible with the khata presently in the builders name and not in the seller’s name.

Presently BBMP is not issuing Khata Certificate and Revenue Department passed an resolution saying that, there is no registration without having Khata (Particularly resale case) ask your seller to get it done or else ask him to take endorsement from the BBMP then i think you can proceed with the registrations otherwise it will prolblem to you in future.

Thanks for the information about the importane of Khata in resale property. We are planning to buy a resale appt in Brigade Metropolis. The owner doesn’t have khata yet. And expecting it in another couple of months. However, they will be getting possession of property in another two months. Could you pls let us know what is the procedure to get endorsement from the BBMP if the property owner doesn’t have khata for appt resale.

The person who have the previous Khata like CMC or Grama Panchayath they can only get the endorsement for the purpose of the registration.

I’m planning to buy an independent house in Ramamurthynagar. However, the owner has not paid the betterment charges and he also doesn’t have Khata in his name. Is it possible to get an endorsement from BBMP and then go for registration? Also, please let me know what the endorsement should state and how much the fees for obtaining it.

I have a site in Bangalore (with katha number) in Kodigehalli. But I have not
paid the property taxes for the last decade or so. How does one proceed? Because of the changes wrt village jurisdiction, CMC, BBMP, etc I am thoroughly confused.

It did not work for me. The site is

Still you can property tax to the BBMP by Cheque or DD in favour Commissiner, BBMP, Bangalore payable at Bangalore, after that only you can prodeed with the Khata Certificate Extract and Khata Certificate of your property.

Dear sir, My property is at kodichikkanahalli and ground floor is constructed in 2004. I have got my Khata from CMC Bommnahalli then. Now I want to construct my first floor and the bank officials asking for BBMP khata. To get BBMP Khata, do I need to follow above process with fresh Khata request? does my case fall under Khata transfer? or is there any specific process for CMC to BBMP khata conversion (please note that I am neither transfering my asset nor it is a new asset)?

Its not like new Khata for the property, theCMC Khata should be tranffered to BBMP Khata thats it. you can obtain from the concerned BBMP office for the same property with the refference of CMC khata

The registration of the Property will be based on your Apartment Super-Built-up area and as well as guideline value of the Property where it is located and in case of property is a rented to any one you can ask the seller to give notice to tenant (Aug,2009) in the mean time you can have Agreement with intended Seller respect to the property saying that property will be registered after vacating of the tenant in the Property

Hello Sir,

If the land comes under tha Grama Panchayath, we need to check the documents of the property and we need to see the Betterment Charges paid or not and tax paid. yes you can buy later on Khata in the name of you from BBMP.

I am planning to approach a natinalized bank to get composite loan buying a site and constructing house. This site owner has the BBMP khata and he is paying BBMP tax, But betterment tax is not yet paid for this property as the BBMP is not recieving it stil. Is there any possibilities that bank might reject the loan application just because betterment tax is not paid?

In fact, I got a letter/endorsement from BBMP saying that this is BBMp property but the khata is still in panchayath. The property tax is paid to BBMP (reciept is there). PLease let me know what you feel about this. Thanks in advance.

I have paid token advance. The builder needs 30% to be paid within 2 weeks to be regidtered with them. The rest can be made when I am registering the proprty in my name with the registrar. I have bought an apartment from a reputed builder(2 months ago in the Kundallahalli area near ACES layout….But i can’t register the property as builder keep saying there is some BBMP/CMC issues. Apartment used to come under CMC and now it falls under BBMP.
I don’t know if he is doing anything on this… Everytime i call the builder he is says govt. is going to withdraw the rule about the khata transfer very soon…. He has also mentioned that he has already applied for the khata transfer and waiting for the govt to act on it..
Is there any specific documents i can ask the builder which can ensure that he is working on it and not just fooling around…
