It is very cumbersome to handle the various different certificates and documents required to proceed if you are either buying or selling property. We attempt to demystify the most prominent of these, Khata.
What is a Khata?
It literally means an account, this Khata is an account of a person who has property in the city. It is an account of assessment of property owners within BBMP (Bruhat Bengaluru Mahanagara Palike) jurisdiction. Khata is important when you apply for any license of building or for trade, applying for loan from any banks or financial institution.It consists all the details of property like name of owner, size of buildings, location of property and all other details that helps to file property tax.
There are two things in a Khata:
a) Khata Certificate
b) Khata Extract.
a) Khata Certificate
A BBMP Khata certificate is required for two major purposes:
1. For registration of a new property,
2. For transfer of any property.For applying khata certificate, the owner of property has to give letter of requisition along with details and receipts of tax paid (latest) to Assistant officer for the sub-division or range. The fee for certificate is RS.25/- per property.Khata Certificate is obtained for any new registration after paying the tax. The certificate is issued saying that a particular property No ‘XYZ’ stands in the name of person A. This certificate is required to apply for water connection, electricity connection, trade license and building license. The Khata certificate is given only to the owner of the property or to his family members. No one else can take it on his behalf. It takes maximum of One week to get the certificate. (When a transaction takes place both the seller and the buyer have to inform the BBMP within three months of the transaction. In case of death of either party, within one year.)
b) Khata Extract
Khata Extract is getting details from the assessment register. The extract is required to get trade license, or to buy a particular property. It has the details of the property like the name, size of the property, use of the property (commercial purpose, residential), annual value, when assessed last.For getting a khata extract, owner of property has to give letter of requisition with property location and details. The fee is Rs.100/- per extract for a period of 5 years of the property.
Eligible for obtaining Khata
All property owners/holders who hold property within the BBMP jurisdiction are eligible to obtain a Khata. Obtaining a khata does not confer ownership of property but confers the person who liable to pay property tax. Property tax can be paid by property owners/holders who may or may not have Khata but it is important when you apply for any license of building or for trade, applying for loan from any banks.
Document required for Khata registration
For applying Khata registration, you needed to enclose following documents along with registration form.
1. Documents required for property of land type- Revenue Pockets / BDA Reconveyed areas / Gramathana :
i. Title deed (Reconveyed documents from BDA in case of BDA Reconveyed areas)
ii. Tax paid receipts and Khatha details
iii. Sketch of your property showing its boundaries and location of site
iv. Improvement Charges
v. National Saving Certificates for Rs.200/-
vi. Encumbrance certificate for vacant sites
vii. Flow chart of title
2. Documents required for property of land type- BDA / KHB Layout
i. Title deed or Possession certificate
ii. National Saving Certificates for Rs.200/-
iii. Encumbrance certificate for vacant sites
iv. Flow chart of title.
What is Khata Transfer?
Khata transfer is required when the ownership of property is transferred from one person to another for any reason like sale of property, gift, will or in case of death of property owner and so on. The application for Khata transfer is same that for registration and the documents needed along with application are following:
1. Title deed
2. Tax paid receipts and Khata details
3. Paid up improvement charges receipt
4. National Saving Certificates for Rs.200/-
5. Death certificate of owner (in case of application due to death own property owner)
6. Affidavit declaring the applicants is legal heirs of the deceased khatedar.
What is Bifurcation of Khata?
Bifurcation of Khata is modifying two or more Khata into one or dividing one Khata into two or more Khata. Application form for bifurcation of Khata is same that applied for registration
Procedure for Registering, transferring and modifying Khata
- Obtain Notarized copy of your sale deed: There are number of notaries in Bangalore where you can get your work done at reasonable fees and the entire sales deed is notarized for charge of Rs 80-100. Normally agents charge good commission per page and charge for get your work done rises to Rs 200 and above.
- Encumbrance certificate (EC): Get EC for your property and one has to carry copy of sales deed for getting EC. Normally EC is handled within 7 working days.
- Application for Khata: Obtain Khata registration form for applying for Khata. Application is same applying for Registration, Transfer and modification of Khata. It is available either online or at any BBMP office. Application costs Rs10.
- Enclosure of documents: While applying for Khata, enclose the essential documents and fill up the necessary information in the application form. Submit the filled registration form at BBMP office and get sealed acknowledgement for the same. Acknowledgement is one of the sheets in the application.
- Check the status of your application: Visit once in 15 days and check the status of your application. Remember any documents demanded by the BBMP office, over and above those listed above, and validated by the RTI is illegal to ask and just a means to harass you and tire you down.
- Seek Information: After 2 months if there is still no activity then file the RTI to seek information on status of khata registration.
- Assessment of Property by Officials: The BBMP Revenue Incharge and Assistant Revenue Officer personally visits the property to assess the property. Please note that if the property is assessed as commercial read as ‘Rented Out’ the property tax is twice the normal property tax.
- Khata Registration fee: After the property is assessed BBMP formally communicates this mentioning the property dimensions (in sq feet), its value as per BBMP assessment and the tax liability thereon. One is also provided with a notice mentioning the same and informing you to pay the Khata Registration fee – 2% of the property values as Khata Registration fee (this is 2% of the value mentioned in the Sale deed). Once you pay the Khata Registration fee, in about 1-2 weeks, one receives the notice for paying the pending property tax. Without this the Khata Extract will not be issued in your name. But if you have reached this point it means Khata has been technically registered on your name.
Fee for Khata related processes
Application for Katha registration, Katha transfer can be applied in the form “Application for Registration/ Modification of Khata”. You can also download the form from BBMP website and link is as follows-

Khata certificate is often misunderstood with title deed. Title deed is the deed agreed between a buyer and seller during the transfer of property and Khata is account of assessment of property. Khata does not confirm ownership of property but assessment of property for the payment of tax. The property owner can pay their property tax in two installments but improvement expense must be paid in lump sum.
You can apply for Registration, transfer or modification of khata in Assistant revenue officer for the sub-division or range between 10 am to 1:30 pm and 2:30 pm to 5:30 pm on all working days. BBMP offers Sarala Khata Scheme Book which is available in major citizens’ service center on payment of Rs.20/-. This book contains guidelines and details for filing application for khata. Iam Planning and finalised an purchase of Flat at Marthalli.
The financial matters / handing over are all finalised. Now the deal has got struck as Iam not able to do the registration as the Khatha transfer is not yet over. This is a second sale the Previous owner has handed over all documents and I have checked the documents through a advocate and has been found been certified by the advocate for correctness.

One of my friend got the Katha for his Individual House where he spent Rs 300 only. But for apartment why the huge amount. I am not getting where these (apartment/individual) clause defined in the Katha Procedure..

I bought a flat in Bangalore in June 2008 and registered on my name. Since many flats still remaining to be sold out, there was no association formed. In the mean time, I came abroad and I am outside India since Aug 2008.
Now association has been formed, and all of them are applying for Khata transfer in bulk. Just wondering if I can apply for Khata transfer once I am back to india by June 2010. I have heard that all flats together apply for Khata transfer and later individually one can’t apply. Please advise.

We have purchased a flat from a builder recently in Bangalore. There is a Joint Dev Agreement between builder and landlord of sharing equal number of flats. The landlord, is asking us for a copy of flat registry papers as he says that he has to submit it to auditor to avoid capital gains tax. As we did not deal with the landlord at all, I feel reluctanct to give him a copy of the papers. Builder has given him Sale deed copy and khata transfer is done. Due to misunderstanding between builder and landlord, landlord is not handing us the original copies of khata transfer.
My query is it safe to give a copy of registry papers to the landlord and how does the landlord get help my registry to save capital gains tax. Do I get anything in writing from landlord before giving him a copy of registry papers.

If Builder dont have the Khata, after the regitration you need to wait till the BBMP Akarama and Sakrama you need to pay penalty and fee, its a problem to you in future also, kindly asdk them to legalise first then you can go for registration.

If your properties are in the Single Sale Deed and Single Khata, when go for sell only one, you need to ask lawyer to draft Sale Deed for one Apartment after the registration of the said apartment, Khata will be trasferred to the intended Purcheser’s by the BBMP only.

I am thinking of buying a resale apartment. The seller has purchased form builder and the individual khata is not available, because they are all waiting to apply for in bulk. In this situation, is it advisable to buy the property or not, since the individual khata is not available for the particular apartment. Builder says that even if I purchase the apartment from 1st seller, I will not get the khata in my name, but the khata will be issued in the name of the seller (who would be gone by then). Then in this situation how can I get the khata to be transferred in my name? Right now, there is no individual khata for the apartments.

Hello Sir,
Today spoke to builder about the Property Tax, he told that it is not needed to pay tax individually until Katha is registered in our names. He told that only we need to pay around 2,500 (for 2008-2009) and 2,500(for 2009-2010) overall and then we need to submit this paid bill to the katha department, then they will process the katha under individual names.
He told there is BBMP building in Jayanagar 4th block, there if we take the katha(which is currently in the name of Nagaraj and Suresh) and the tax bill paid by him during 2007-2008 and if we pay the 5000/- rupees to them then they will give a bill for 2008-2009 and 2009-2010 and then we need to submit this bill to the katha department for further process ( I think if we do this then we can give the bill for further process).
He also told that what the broker told about 4000 individual is not right and asked no need to pay that much huge amount. So, I am not sure as whom to follow and what needs to be done. Please help as on this regard

Dear Shri Nagendra,
I have a penthouse in Sai Krupa Apartment, behind Bhagini restaurent on KR Puram – Marathahalli outer ring road (opp Akme Balle, ~4 km from KR Puram flyover).
This building has five floors (0, 1, 2, 3, 4), and -1 (ground level) being parking lot. The plan approval is there up to 3rd floor, but penthouse is located on 4th floor and there is no plan approval for entire 4th floor (that is, for all 12 penthouses on 4th floor). Khata certificate and Khata abstract are yet to be obtained. Meanwhile, we registered the property (jointly by me and my spouse) on 11-11-2008, but for some personal reasons, we want to sell it.
Now, there is a serious buyer, and he wants to see a legal document for plan approval of 4th floor (on which this and all other penthouses are located).
To this, builder mentioned that he will provide “Khata Ceritifcate” and “Khata Abstract”, and as per the builder, Khata certificate is issued by govt only after deviation due to penthouses is regularized. So, once Khata Certificate is issued, it is equivalent to plan approval and being legal in all respects.
So, my first question is: Will obtaining Khata certificate for penthouse ensure that it is fully legal and approved.
When we asked the builder to go ahead and obtain “Khata Certificate”, he mentioned that govt has put on hold issue of Khata Certificate, and is not issuing Khata Certificate to anyone at this point of time. Once govt finalizes its policies, they will again start issuing Khata Certificate, and it may take few months from now. However, it is still possible to obtain Khata Abstract, and banks have agreed to give home loans based on Khata abstract only.
So, my second question is: Is above (builder’s version) correct and can we believe that.

I am planning to purchase a house in Ramamurthy nagar area which is now under BBMP. My vendor has purchased this property in 2006. Due to CMC to BBMP conversion, the vendor couldnt yet transfer khata to his name. He has a CMC khata in the name of the previous vendor which has been submitted in SBI for loan purpose. BBMP is yet to collect the betterment charges. From my enquiries, this is a common problem in many new BBMP converted areas in Bangalore, correct me if I am wrong..
Now is it safe to buy this property if we include the following condition in the sale agreement;
1. “My vendor must provide a BBMP khata and khata extract to me in next 6 months”. ie, he will pay betterment charges which is expected there in 2-3 months, then convert the old cmc khata in the previous vendors name to his name.
Will there be any problem in registering the property in my name now? He has all other documents exept the khata.

In Bangaloreall facing problems like this but we need to check whether property got converted or not and CMC Khata genuinity, we can have Indemnity bond saying that he has to pay the betterment charges towards the plot.

I had purchased a plot in a layout within Mahadevapura CMC area (Brooksfield) but I never got the Khata transfered from the builder to my name (due to various issues within CMC and BDA restrictions on CMC since mid-2003). But I have been paying Tax regularly. Now I hear that BBMP have started issuing Khata and Transfer Of Khata. If this is true, since the original Khata covers multiple plots in the layout, do I need to apply for Khata Bifurcation or just Khata Transfer ?

I own a flat in Brookfields which i bought 2 years back from DSR Builders whose office is in koramangala. There are totally 208 apartments. It was a joint venture between the land owner and builder. The registeration process is completed and the association is also in place now. The khata transfer is not done and also we have got only an acknowledgement for the application for Occupancy certificate. Have not received the OC yet.
For the khata transfer, we have the following issues

2. Property Tax not paid for 2 years (2005 to 2007)
3. Betterment charges
The construction was completed in 2007 and people started to move in starting form feb 2007.

1. Who has to pay the betterment charges??
Betterment Charges are decided by the Builder and Purchasers before buying apartments or any one has to pay its depends upon the Agreements and commitments of the both but BBMP need is Betterment Charges.
2. Who has to pay the property tax for the 2 years (2005 to 2007)???
As per your details construction finished on 2007 so for the 2005 to 2007 Tax will be paid by the builder for the land and not for the Apartments.
3. Is it mandatory to have the OC for applying the khata transfer.????
Its mandatory to obtain OC from the BDA for the Khata Transfer, i.e. builders responsibility to get it.
4. Currently the apartment is in survey no. Can the khata transfer be carried over independently for each flat, or it shud be done for all the flats together(is it mandatory)???
Khata will be bifurcated as per your APartments Sy. No. or BBMP decides based on the Property
Solutions:
BBMP is issuing B-Khata based on the Sale Deed and Tax paid receipts, I would like to advice you all go for this now. indidually can apply for this.

Regitration of Sale Deed is different and Khata Transfer is different, after the registration you need to apply for the Khara Transfer in the concerned BBMP office with the support of Sale Deed and Tax paid receipt and other related documents.

I purchased a plot in 2003 and had all Registration & Katha documents done on my wife’s name at Krishanrajapura Office, We paid the Tax at the time of Registartion and later one Year. We have purchased the flat last year (2008) now its time for the most annoying process of Khata Transfer. One of the residents who is also the previous owener of the land on which the appartment is constructed has taken the initiative to get the Khata Transfer done. We have been aske to pay a bribe of 5250 each for the same. None in the apartment want to protest this including my own family which says why should we stray from the rest. How do I get help? Is there any group with whom I can liase and fight for this cause?

My mother bought a site from one of our relatives in 1998 in Thindlu,byatrayanapura. Time she had only paid the amount and it was registered to my name in 2006. i dont know for how long the previous owner has paid the betterment charge,tax etc.we are paying the tax only from that year(2006) of registration.
now i have to get the khata done and i have to apply for the loan. i heard that we cant get the khata done nowand we have to wait for akrama sakrama,is it true?

A friend of ours, living abroad, has a plot of land in Eagleton Golf Village on Mysore Road. We’re helping him sell it here. However, we’re not sure if the Khata papers are needed for this area. First of all, does Eagleton come under BBMP? If not, do we still require Khata papers to sell the plot?
Secondly, if he is not able to come down here to sell it, can he give the Power of Attorney to us to do so?

I have purchased a flat from one of the two owners of land, on which an apartment complex was built under a JDA with a builder. The flat was purchased and registered from one of the landowners who has an allocation of share of flats. The subject flat is a part of that allocation under the JDA. EC has been obtained and shows the purchase against my name. I bought an apartment in Yelahanka from the builders. The Sale Deed was registered in April, 2007. I took possession of the apartment in June 2007. At the time of taking possession, the builders took Rs.10,000.00 for the purpose of Khata which also included property tax for the year 2006-07. In July, 2007 I was given a document written in Kannada issued by the Yelahanka Nagar Palike Karyalaya (CMC) as also the tax assessment and receipt for the year 2006-07. The document, which I was told was the Khata, contained all the details including Serial no. the apartment no., address, owners name, area, assessed property tax etc. etc. Since then I have paid property tax for the years 2007-08, 2008-09 and 2009-10 giving the Sr no. of this document as my khata no. Also, I used the copy of the same document to get my BESCOM bill transferred from the builders’ name to my name. Now here are my questions:
1) Is the document I have with me a Khata Certificate or it is a Khata Extract (It is green in colour and the data has been given in a tabular form. In the top right hand corner it says in print NAKALU in Kannada. I presume it means COPY)
2) If it is an extract do I need to get a certificate? If YES, then how do I do it?
3) My document was issued by Yelahanka CMC. Should I need to do something at this time because Yelahanka CMC is now part of BBMP?
Will appreciate a reply to the above questions

I am planning to buy a flat in Marthahalli from the land owner.The apartment is constructed on an agreement between the land owner and builder.The flat i am planning to buy is 1200 sq ft.As per the santioned plan the apartment got approval for 5 floors,but in the floor(1st floor) i am planning to buy they have got approval for only 2000 sq ft.
The flat has got Khata registered and I checked the khata extract too.In Khata extract too it is mentioned a built up area of 1200 sq ft.Does this mean that the plan is an approved one? Does this variation in area santioned will create an issue in future.Pls advice.

As of noe BBMP is issuing B-Khata to the Apartments, here do need to pay the betterment charges it will in force of 2 years meanwhile you need to get the Final Khata Certificate.

BBMP is charging huge money to provide this B-Khata. Are they providing the khata’s only to those site whre in betterment charges is already Paid to the existing body?
For example provide khata only if one has paid betterment charges to Panchayat/cmc.

I own One BDA Site in Chudenapura Village, Kengeri Hobli and one apartment in Old Airport Road. I payed Rs 15000 as a bribe to get Khata for my BDA site and Rs 10000 to get Khata to my apartment. (total 20 flats are there in my apartment all pay 10K each) If this thing I know before (year back) I can able to save that money, anyways atleast the peoples are aware now.
After a very long struggle I manage to find which zone my BDA Site is located.
I went to Pay Property tax for my BDA Site in Kengeri Hobli BBMP Tax Collection Help Centre; it starts with bribe of Rs 10 to security to know where the officer is. Then I met the office and he referred me to the other tax collection centre which is in Mailasandra. I went there and learned from the office that I cannot pay tax to a BDA site which is not having the BBMP Khata number.
Then I asked him how to pay the tax?
He told “you hv to pay Rs 40000 as a Development charges to BBMP and you can get the BBMP khata and then you can pay the tax”
To enquire about BBMP Khata I went to BBMP Ward office, Citizen Service Centre in Madiwala. There one person saw my sale deed and BDA khata papers and said “boos this is a very difficult task” “I will refer one person you go and meet him” office dialed his mobile phone, after 5 mins one person came, office told “go with him he will tell you what need to be done”
That person again saw my documents and said it will cost Rs 20000 + what ever the BBMP development charges. I Disappointed and come back home, I didn’t take his contact information also (after hearing this my mind fails to work)

I heard that sometimes duplicate documents are produced by false owners and the sale deed is regsitered. After some time, the real owner comes back and finds that there is someone else staying with a house also being built on it. I am finding it really scary to buy land in Bangalore. This has happened to a known person of my friend. Does the lawyers/bank do not find out these fraud when they go through the documents? Not sure what went wrong in this case. Is there any way you can find if the document is original or duplicate? Pls advice.
