It is very cumbersome to handle the various different certificates and documents required to proceed if you are either buying or selling property. We attempt to demystify the most prominent of these, Khata.
What is a Khata?
It literally means an account, this Khata is an account of a person who has property in the city. It is an account of assessment of property owners within BBMP (Bruhat Bengaluru Mahanagara Palike) jurisdiction. Khata is important when you apply for any license of building or for trade, applying for loan from any banks or financial institution.It consists all the details of property like name of owner, size of buildings, location of property and all other details that helps to file property tax.
There are two things in a Khata:
a) Khata Certificate
b) Khata Extract.
a) Khata Certificate
A BBMP Khata certificate is required for two major purposes:
1. For registration of a new property,
2. For transfer of any property.For applying khata certificate, the owner of property has to give letter of requisition along with details and receipts of tax paid (latest) to Assistant officer for the sub-division or range. The fee for certificate is RS.25/- per property.Khata Certificate is obtained for any new registration after paying the tax. The certificate is issued saying that a particular property No ‘XYZ’ stands in the name of person A. This certificate is required to apply for water connection, electricity connection, trade license and building license. The Khata certificate is given only to the owner of the property or to his family members. No one else can take it on his behalf. It takes maximum of One week to get the certificate. One can also get it instantly in some citizen service centers (details: http://www.bmponline.org/citizen-svc-centersl.shtml)
(When a transaction takes place both the seller and the buyer have to inform the BBMP within three months of the transaction. In case of death of either party, within one year.)
b) Khata Extract
Khata Extract is getting details from the assessment register. The extract is required to get trade license, or to buy a particular property. It has the details of the property like the name, size of the property, use of the property (commercial purpose, residential), annual value, when assessed last.For getting a khata extract, owner of property has to give letter of requisition with property location and details. The fee is Rs.100/- per extract for a period of 5 years of the property.
Eligible for obtaining Khata
All property owners/holders who hold property within the BBMP jurisdiction are eligible to obtain a Khata. Obtaining a khata does not confer ownership of property but confers the person who liable to pay property tax. Property tax can be paid by property owners/holders who may or may not have Khata but it is important when you apply for any license of building or for trade, applying for loan from any banks.
Document required for Khata registration
For applying Khata registration, you needed to enclose following documents along with registration form.
1. Documents required for property of land type- Revenue Pockets / BDA Reconveyed areas / Gramathana :
i. Title deed (Reconveyed documents from BDA in case of BDA Reconveyed areas)
ii. Tax paid receipts and Khatha details
iii. Sketch of your property showing its boundaries and location of site
iv. Improvement Charges
v. National Saving Certificates for Rs.200/-
vi. Encumbrance certificate for vacant sites
vii. Flow chart of title
2. Documents required for property of land type- BDA / KHB Layout
i. Title deed or Possession certificate
ii. National Saving Certificates for Rs.200/-
iii. Encumbrance certificate for vacant sites
iv. Flow chart of title.
What is Khata Transfer?
Khata transfer is required when the ownership of property is transferred from one person to another for any reason like sale of property, gift, will or in case of death of property owner and so on. The application for Khata transfer is same that for registration and the documents needed along with application are following:
1. Title deed
2. Tax paid receipts and Khata details
3. Paid up improvement charges receipt
4. National Saving Certificates for Rs.200/-
5. Death certificate of owner (in case of application due to death own property owner)
6. Affidavit declaring the applicants is legal heirs of the deceased khatedar.
What is Bifurcation of Khata?
Bifurcation of Khata is modifying two or more Khata into one or dividing one Khata into two or more Khata. Application form for bifurcation of Khata is same that applied for registration
Procedure for Registering, transferring and modifying Khata
- Obtain Notarized copy of your sale deed: There are number of notaries in Bangalore where you can get your work done at reasonable fees and the entire sales deed is notarized for charge of Rs 80-100. Normally agents charge good commission per page and charge for get your work done rises to Rs 200 and above.
- Encumbrance certificate (EC): Get EC for your property and one has to carry copy of sales deed for getting EC. Normally EC is handled within 7 working days.
- Application for Khata: Obtain Khata registration form for applying for Khata. Application is same applying for Registration, Transfer and modification of Khata. It is available either online or at any BBMP office. Application costs Rs10.
- Enclosure of documents: While applying for Khata, enclose the essential documents and fill up the necessary information in the application form. Submit the filled registration form at BBMP office and get sealed acknowledgement for the same. Acknowledgement is one of the sheets in the application.
- Check the status of your application: Visit once in 15 days and check the status of your application. Remember any documents demanded by the BBMP office, over and above those listed above, and validated by the RTI is illegal to ask and just a means to harass you and tire you down.
- Seek Information: After 2 months if there is still no activity then file the RTI to seek information on status of khata registration.
- Assessment of Property by Officials: The BBMP Revenue Incharge and Assistant Revenue Officer personally visits the property to assess the property. Please note that if the property is assessed as commercial read as ‘Rented Out’ the property tax is twice the normal property tax.
- Khata Registration fee: After the property is assessed BBMP formally communicates this mentioning the property dimensions (in sq feet), its value as per BBMP assessment and the tax liability thereon. One is also provided with a notice mentioning the same and informing you to pay the Khata Registration fee – 2% of the property values as Khata Registration fee (this is 2% of the value mentioned in the Sale deed). Once you pay the Khata Registration fee, in about 1-2 weeks, one receives the notice for paying the pending property tax. Without this the Khata Extract will not be issued in your name. But if you have reached this point it means Khata has been technically registered on your name.
Fee for Khata related processes
Application for Katha registration, Katha transfer can be applied in the form “Application for Registration/ Modification of Khata”. You can also download the form from BBMP website and link is as follows-

Khata certificate is often misunderstood with title deed. Title deed is the deed agreed between a buyer and seller during the transfer of property and Khata is account of assessment of property. Khata does not confirm ownership of property but assessment of property for the payment of tax. The property owner can pay their property tax in two installments but improvement expense must be paid in lump sum.
You can apply for Registration, transfer or modification of khata in Assistant revenue officer for the sub-division or range between 10 am to 1:30 pm and 2:30 pm to 5:30 pm on all working days. BBMP offers Sarala Khata Scheme Book which is available in major citizens’ service center on payment of Rs.20/-. This book contains guidelines and details for filing application for khata. Normally builder register the Site in your name and later they do the constructon because of some legal and approval issues and if it is second sale you should register the plot with construction (building) it is safe for your property

We purchased site in Munnekolala around six months back with documents of parent deed / tax paid receipts till 2009 and B katha. As per info got earlier this area under Green Belt limits and now it’s come BBMP limits hence approached BBMP office (Kundalahalli / Marathahalli) to transfer B katha in our name but they rejected and said they have not received any orders.
Whether we can transer B katha in our name or not, if possible what is procedure or consultant details please, with this reason even LIC Housing has not accepted our application

Even I went through the same situation. I had purchased a property last year and wanted home renovation loan.
B-khata is not transferable. It is issued only once in 3 years. You should submit the original in the registrar’s office during the transaction. If you pay tax for next 3 years, you can get it in your name.

My father , through a registered will, has bequeathed a property in Jayanagar to me with the life interest to my mother. He also has mentioned that my mother can only enjoy the property as long as she lives. She can not sell or mortgage. However she can lease for not more than 3 years. Also he has mentioned that my brother has got eaqual share if not more. I suggest you to wait till June As per the latest update BJP government is suppose to release akkrama and sakkrama which help u to get permanent PID and katha certificates
a) you can pay the tax with the help of sale deed.
b) u have an option to get B-katha, However, some of the banks will not give loans with this katha ( Note:- Bkatha cannot be transfered).
c) If u r seller already had katha and katha number, then u can get it transfered in u r name easily and then apply for loan.

I have taken an apartment at Uttarahalli. Since it was a revenue site, I got the Khata transferred in my name. Now the area is notified by the Govt. to be included under the corporation. We are yet to see any communication though in this regard. We are also yet to get notice to pay the betterment charges. I have paid the property tax for 2008-09, 2009-10 and 2010-11.
I understand that to make a khata now in my name under the corporation, this would be called as Khata Registration. Correct me if I am wrong.
Further, I took help of the same person who had arranged for my earlier khata transfer. He says it will be Rs 18,000/- Is it justified ?
What would happen if I delay this process by a year or two ?

One of my Aunty has a site in Nagenahalli and am guessing it is a revenue site and she was paying betterment charges till 2000 I guess. She has not got the Khata Registration done.
However she has taken the green form 3 years back and she has paid the TAX. Now she has paid the TAX for 2009, 2010 and 2011. from past 3 years she is paying the TAX and she also has the EC in her name. She has contacted the Assistant revenue officer also for this and they are saying that Khata Registartion has not yet started but she was told that she can get the Khata Extract.Is this true. Should I meet the Revenue Officer. Do you think anybody can forge any documents in thier name , but my Aunty has the Sale Deed/Title deed, EC , Tax paid certificates..All the original documents in her name.
By Having Khata Extract , will it be legal for us to go ahead if any of her neighbor is trying to forge any documents for her site.what is your advice?

I am having problem in paying the TAX online

1) 2008-2009 ( Tax paid by the Seller) and seller name is reflecting in online records
2) 2009-2010 ( Tax paid by me ) I got a manual recepit bill by BBMP (not updated online)
3) 2010-2011 ( Tax Paid by me) I got a manual recept bill by BBMP (not updated online)
Even after transfering the katha in my name, the online records are not updated by BBMP because of which I am not able to pay the bill online. I think there is some problem in record updation Kindly help me how to get rid of this problem.
I visited the jakkur BBMP office, The officer refused to do the new updations. however, He told, it is not possible to update the records and he collected money for 2010-2011,I am really confused why i need to pay my TAX in the name of old seller is really disgusting.
a) Is there any reason why BBMP has not updated records properly?
b) Please help me what is the procedure to update this record?

BBMP head office has to do that work, you can go and check in hundson circle BBMP they will do the transfer in computer.

I need some information about a property (residential vacant site) of my sister which is at Kalkere Village near Horamavu.
My sister purchased this site in 1999 and has a khatha issued by grampanchayat that time. Im not sure if its called khatha or khatha extract. I have paid the tax for this site till 2009-10 and will be paying the tax for 2010-11 before May 30th 2010.
Now my sister wants to sell the property, Is it possible to do so and what do we need to do to sell it?
1. Is B-Khatha in my sister’s name necessary to sell it?
2. Which registrar office should this the sale deed be registered?
3. Does akrama/sakrama applicable to this property and how?

I have purchased a flat in Bellandur area of Bangalore. I want to get the khata transfer done at the earliest. What is the procedure of getting the same done in minimum possible time, without any problems and obstacles? Also, is it possible to get the transfer done easily and conveniently, without the help of a broker and without much headache? Also, how much time will it take to get the khata certificate? What will be the fee and other charages?
Is it advisable to through the broker so that things can be done easily and correctly? What will be the broker fee in such a case?

I have purchased a flat (second sale) and the previous owner was having a “Form-B KHATA”. I paid the property tax and everything. Will there be an issue in getting KHATA of the flat in my name? B katha is issued to facilitate the registration process. It will not convey or confer any right, title and interest. You may approach the jurisdictional ARO with your request.

My father purchased a site in Kalkere Village(Rammurthy Nagar) about 10-15 years back. The layout is called NRI layout. My father passed away 4 months ago. The legal heirs are me, my brother and my mother.
Please guide me the process of getting the site transferred in our name. It can be my mother or me or my brother. We have regularly paid all property tax till date.

I have an apt in Bellandur area which was bought in 2004. After that I never did the khata transfer from the builder to myself.
Now I heard that we are getting BBMP khata for our apartments. So, can I apply for BBMP khata directly or do I need to still go to panchayat first and then convert it to BBMP?
How much the whole process may cost? Any inputs are greatly appreciated.

My uncle has a house in K R puram(BBMP limits). He purchased(in 2008) the site and constructed the house much before BBMP/CMC stopped issuing kathas. At that time he has not got the kataha transfered to his name from the owner of the site. Can he get the kataha transfered now.? He has been paying the property tax till now. Can he get B-kataha? Is B-katah enough to get loan from banks (at least some banks). Could you please reply.

I need one information regarding a flat which my friend is interested to purchase. The Flat is having issues with Raj Kaluva and the Builder already constructed the flats and sold off . Now the BBMP guys came and marked with Rajkaluva . Is it safer to go ahead with the deal of the flat or does it have any legal implications ?

i have purchased a gramathana site in nagarbhavi 2nd stage. The seller initially had a CMC katha but obtained a BBMP katha and certificate later. I purchased the site after seller obtained BBMP katha and extract in his name.
Now i have purchased the same and applied for katha transfer in the joint names of self and my wife. I have enclosed EC document till June first week of 2010, whereas the property was registered in the last week of May 2010. The EC shows the transfer of property in my and my wife’s name.
I want to now whether the EC document will suffice as the BBMP office staff told that it will take about one month for katha transfer. I have applied for katha transfer in the 2nd week of June 2010. By this, katha transfer should be completed in the 2nd or 3rd week of July 2010. Kindly confirm whether i should go to BBMP office once every week or so to update the status or do they need any other documents. I have submitted all the required documents as mentioned in the application form.

I have a revenue site ( Open land) in Bomanhalli,Bangalore 560068. I have paid all land tax upto 2010-2011, I do not have its Khata, I enquired about obtaining its Khata, the concerned staff in BBMP office, Bomanhalli told me, you can make only ‘B’ khata, you can not get the ‘A’ khata . I could not understand what is ‘A’Khata and what is ‘B’ khata.

Katha(regular) is issued for sites which are, DC converted and approved by the planning authority. Since, there are innumerable sites in revenue layouts, without approvals, without change of land use and gramthana sites, which are amalgamated into bbmp, to facilitiate the sales, the BBMP is issuing B katha.
