Khata Transfer Bangalore, Khata Registration and How tos

It is very cumbersome to handle the various different certificates and documents required to proceed if you are either buying or selling property. We attempt to demystify the most prominent of these, Khata.


What is a Khata?

It literally means an account, this Khata is an account of a person who has property in the city. It is an account of assessment of property owners within BBMP (Bruhat Bengaluru Mahanagara Palike) jurisdiction. Khata is important when you apply for any license of building or for trade, applying for loan from any banks or financial institution.It consists all the details of property like name of owner, size of buildings, location of property and all other details that helps to file property tax.

There are two things in a Khata:

a) Khata Certificate
b) Khata Extract.

a) Khata Certificate

A BBMP Khata certificate is required for two major purposes:
1. For registration of a new property,
2. For transfer of any property.For applying khata certificate, the owner of property has to give letter of requisition along with details and receipts of tax paid (latest) to Assistant officer for the sub-division or range. The fee for certificate is RS.25/- per property.Khata Certificate is obtained for any new registration after paying the tax. The certificate is issued saying that a particular property No ‘XYZ’ stands in the name of person A. This certificate is required to apply for water connection, electricity connection, trade license and building license. The Khata certificate is given only to the owner of the property or to his family members. No one else can take it on his behalf. It takes maximum of One week to get the certificate. (When a transaction takes place both the seller and the buyer have to inform the BBMP within three months of the transaction. In case of death of either party, within one year.)

b) Khata Extract


Khata Extract is getting details from the assessment register. The extract is required to get trade license, or to buy a particular property. It has the details of the property like the name, size of the property, use of the property (commercial purpose, residential), annual value, when assessed last.For getting a khata extract, owner of property has to give letter of requisition with property location and details. The fee is Rs.100/- per extract for a period of 5 years of the property.

Eligible for obtaining Khata

All property owners/holders who hold property within the BBMP jurisdiction are eligible to obtain a Khata. Obtaining a khata does not confer ownership of property but confers the person who liable to pay property tax. Property tax can be paid by property owners/holders who may or may not have Khata but it is important when you apply for any license of building or for trade, applying for loan from any banks.

Document required for Khata registration


For applying Khata registration, you needed to enclose following documents along with registration form.

1. Documents required for property of land type- Revenue Pockets / BDA Reconveyed areas / Gramathana :

i. Title deed (Reconveyed documents from BDA in case of BDA Reconveyed areas)
ii. Tax paid receipts and Khatha details
iii. Sketch of your property showing its boundaries and location of site
iv. Improvement Charges
v. National Saving Certificates for Rs.200/-
vi. Encumbrance certificate for vacant sites
vii. Flow chart of title

2. Documents required for property of land type- BDA / KHB Layout

i. Title deed or Possession certificate
ii. National Saving Certificates for Rs.200/-
iii. Encumbrance certificate for vacant sites
iv. Flow chart of title.

What is Khata Transfer?

Khata transfer is required when the ownership of property is transferred from one person to another for any reason like sale of property, gift, will or in case of death of property owner and so on. The application for Khata transfer is same that for registration and the documents needed along with application are following:

1. Title deed
2. Tax paid receipts and Khata details
3. Paid up improvement charges receipt
4. National Saving Certificates for Rs.200/-
5. Death certificate of owner (in case of application due to death own property owner)
6. Affidavit declaring the applicants is legal heirs of the deceased khatedar.

What is Bifurcation of Khata?

Bifurcation of Khata is modifying two or more Khata into one or dividing one Khata into two or more Khata. Application form for bifurcation of Khata is same that applied for registration



Procedure for Registering, transferring and modifying Khata

  1. Obtain Notarized copy of your sale deed: There are number of notaries in Bangalore where you can get your work done at reasonable fees and the entire sales deed is notarized for charge of Rs 80-100. Normally agents charge good commission per page and charge for get your work done rises to Rs 200 and above.
  2. Encumbrance certificate (EC): Get EC for your property and one has to carry copy of sales deed for getting EC. Normally EC is handled within 7 working days.
  3. Application for Khata: Obtain Khata registration form for applying for Khata. Application is same applying for Registration, Transfer and modification of Khata. It is available either online or at any BBMP office. Application costs Rs10.
  4. Enclosure of documents: While applying for Khata, enclose the essential documents and fill up the necessary information in the application form. Submit the filled registration form at BBMP office and get sealed acknowledgement for the same. Acknowledgement is one of the sheets in the application.
  5. Check the status of your application: Visit once in 15 days and check the status of your application. Remember any documents demanded by the BBMP office, over and above those listed above, and validated by the RTI is illegal to ask and just a means to harass you and tire you down.
  6. Seek Information: After 2 months if there is still no activity then file the RTI to seek information on status of khata registration.
  7. Assessment of Property by Officials: The BBMP Revenue Incharge and Assistant Revenue Officer personally visits the property to assess the property. Please note that if the property is assessed as commercial read as ‘Rented Out’ the property tax is twice the normal property tax.
  8. Khata Registration fee: After the property is assessed BBMP formally communicates this mentioning the property dimensions (in sq feet), its value as per BBMP assessment and the tax liability thereon. One is also provided with a notice mentioning the same and informing you to pay the Khata Registration fee – 2% of the property values as Khata Registration fee (this is 2% of the value mentioned in the Sale deed). Once you pay the Khata Registration fee, in about 1-2 weeks, one receives the notice for paying the pending property tax. Without this the Khata Extract will not be issued in your name. But if you have reached this point it means Khata has been technically registered on your name.

Fee for Khata related processes


Application for Katha registration, Katha transfer can be applied in the form “Application for Registration/ Modification of Khata”. You can also download the form from BBMP website and link is as follows-

Khata certificate is often misunderstood with title deed. Title deed is the deed agreed between a buyer and seller during the transfer of property and Khata is account of assessment of property. Khata does not confirm ownership of property but assessment of property for the payment of tax. The property owner can pay their property tax in two installments but improvement expense must be paid in lump sum.

You can apply for Registration, transfer or modification of khata in Assistant revenue officer for the sub-division or range between 10 am to 1:30 pm and 2:30 pm to 5:30 pm on all working days. BBMP offers Sarala Khata Scheme Book which is available in major citizens’ service center on payment of Rs.20/-. This book contains guidelines and details for filing application for khata.     My dad bought 65×65 plot in banashankari and gave it to me

    as a gift in 1977,in 1979, I moved to Uk with my husband, in 1995 we built

    house on that plot,at the movement the house we given it for a rent.just few months ago the tent informed us, Bda came round asking about information on property.then we went through all the documents

    I have purchased a flat in Arekere area (Bannerghatta road) and builder has CMC khata now. Builder has applied for BBMP khata but will take some time.
    After my registration, I need to apply for individual khatat then
    1) Should I need builder’s BBMP khata? or CMC khata is enough?
    2) Would I have pay any betterment charges also?

    Builder has paid property tax upto date.

    Hi

    I have a panchyat land near Ramamurthy nagar , in Marakondanahalli, tc palaya road. I have the katha for the land and the tax paid till date. Is there a possibility that I can convert this land to BBMP and obtain a BBMP katha. In panchyat office they say that the land will be converted to BBMP soon but have not given and time frame.
    I am planning to sell this site at the earliest and since this is a panchyat land , there is no loan avaliable ( As i understand from banks) . Loan is avaliable onle for BBMP lands.
    I am trying to sell this site for a long time and because of this issue no one is comming forward.
    Please suggest.

    Sir,

    My sister has a land of 10.7X45 feet. As per the BBMP plan sanction only two floors will be given to construct it. So, we(I and my brother) gave 3.5 feet out of our 6 feet passage. As per the BBMP plan sanction minimum 14 feet is required to construct more than two floors.
    However, issue of khatah will not be given to 3.5X45 feet as we will be getting only 2.5 feet of passage.
    As, this is L shape property, my sister has a front portion and moreover she will be giving us the stilt floor for parking to utilize. But, still I can’t get khatha for her property. We can’t club the property again because 14 feet will be utilize tomorrow and again 2.5 feet passage will be left. And more important this property is L-shape and we can’t divide as we don’t have other options.
    We require khata for 3.5 feetX45 feet as we need to get a plan sanction from the BBMP office for applying a loan from the bank. We’ve done 3 registration as per the legal advice and BBMP advice in the 8 months.

    So, please advice what are the other options available. Is Endorsement valid in getting the BBMP plan sanction and applying a loan in a bank?

    The existing khatadar(seller) had to go abroad for 5 months. I want to know if i can get the transfer done only on his arrival, since his signature is required ?

    Is there any penalty for not getting the transfer done within 3 months of registration ?

    Has anyone gone through this situation ?

      IN your case registration is done so you need to take your seller signature in the katha transfer form. later you can apply for the same thee is no penalty will implicated if your not transferred the katha for your safety you need to get it done

        The owner obtained a BBMP Khatta last month. I heard that BBMP is not issuing
        any Khatha these days. How to verify the genuinity of the Khatha. Also, the owner is saying
        betterment charges already paid by the original developer, is it possible.

    I am having a query. In the past the layouts which came up in Hosur Road, Bellary Road, Mysore Road, etc. used to be part of CMCs (at that time seven CMCs were there) and accordingly the Khata was issued from CMCs. Now all these CMCs are brought under BBMP, it is said that there is a need for getting new Khata from BBMP but the same is not being issued citing the reasons of Aakrama and Sakrama.

    In what way this issues affects the buyer and seller of a property. I was told that the houses which were constructed say about 4-5 years back with CMCs plan approval won’t have this problem where as others will face problems.

    Even it is being told that BBMP can re-work on the layout plans.

    I request the knowledgeable persons to throw light on this issue.

    I purchased an aprtment in 2007. My builders took almost 24k from me towards khata registarion. After that i moved to US and i never got any documents from my builders. I tried to contact them but no reply.
    They have cheated me. I am not sure they registered my khata or not.

    My Apartment is in vijayabank layout bannerghatta road bangalore. Can i go to kormangala BBMP office and check whether khata is registered or not. If done what are the details i need to provide to get the registration copy

    If not done what is process of doing it now

    Even tax is not paid for the apartment from 3 years

    It looks like they havent take the khata or not giving the documents to me
    Can i appaorach the BBMP now for getting the duplicate coipy of khata or for registation of it now.

  27. I have a property at Egipura, near Kormangala under High Tension Wire. But I had not applied for Katha Till Date. I need to despose the property urgently. But BDA is not issuing the Katha Certificates.

    Kindly suggest me to obtaining Katha Cetifcate at the earliest.

      Regarding the said property in Egipura near Kormangala under high Tension Wire.
      I have house built with KEB , BWSSB connections and receiving the bills and paying the bills regularly.
      My next house has Katha certificate and other houses also.
      For my house Improvement charges (betterment charges) has been paid through DD and Receipt has also issued for the same. But on verfication the case worker is tellling it is not entered in register therefore it is not valied to issue Katha.
      Kindly suggest me how to approach BDA to get the Kath certificate at the earliest. as I have to sell the property at the ealiest to meet my urgent needs.

    I have purchased a portion of a DC converted site in Kundanahalli village (Krishvi Orchid Woods layout) and it got registered in June 2010.

    The previous owner was having a B-khata for the entire site and betterment charges were not paid since BBMP was not accepting this.

    Now I want to apply for a B-khata for my portion as I am planning to proceed with my house construction & hence need plan approval etc.

    Please advise me in this regard on how I can obtain B-khata for the portion I purchased

        It is not B Katha it is called as B – Form Register, here you need to wait till akrama -sakrama, no need to get the B- Form in your name. B- Form will used only for the purpose of registration not for the plan approval.

          now i need to furnish the construction approval plan to get the disbursement of full loan amount for construction.

          Could you please suggest me? From where i can get the approved plan for construction?

          Since i’ve taken composite home loan for which i need to start the construction within 6 months otherwise my home loan will be converted to personal loan rate of interest.

          I would like to start the construction asap, Please help me how to go ahead on this.

    We a property in shivajinagar measuring 909 sqft.

    We have constructed lower ground floor (750 sft) , ground floor (780 sft) and first floor (750 sft). (approved plan for ground floor and first floor only)

    We have katha and assessment done for lower ground floor (680 sft), ground floor (650 sft) and first floor (650 sft) in our name and paying tax since eight years.

    Now, we are intending to sell only ground floor and first floor and retaining lower ground floor. When we consultant a BBMP official he said because of the bifurcation and violations made in construction they can issue B katha to us and the buyer of the GF and FF.

    What is this B katha and is it safe for us to go ahead with the deal.

    Can we regularise B katha to a normal katha in Akrama-Sakrama

    I have bought a flat recently. It comes under the jurisdiction of Village panchayat. The Katha for the flat was already registered in my previous owners name. I want to transfer the same onto my name. When I approached the panchayat office for the same, they are demanding a 2 percent fee on the entire sale value. The property cost is around 18 Lakhs. Can you help me out clarifying this matter. Should the katha transfer fee be 2% of entire sale value or should it be 2% of the registration fee paid during the registration. Paying 36thousand just to transfer katha to my name does not seem reasonable.

    I have purchased a site in Krishanappa Layout (Near Hosakerehalli), but property owner gave the GPA to a person in 1994 & then the GPA holder has sold the property to other person in 2007 & the registration was done by GPA holder itself. Now I have purchased the same site. I have given some amount as advance & still the registration is pending. Please advice me on risk of buying this property.

    I have purchased a site in Bannerughatta Road in 2005 and site is registered in my name. Earlier it was gram panchayat area. No conversion is available. However BDA notification and NOC is available. In that area nearly 20 houses have been constructed.
    only my site is vacant. I have paid the property tax till date regularly. When I applied for Khata from BBMP, it was informed that only B – Khata Extract will be given. Now I want to construct a house there. What shall I do? With B Khata whether house plan will be approved by BBMP?

      With the help of B – Katha plan will not be approved by the BBMP you need to betterment charges then you can get the Katha as well as Plan approval from the BBMP

      Local Gram Panchayath will do the assessment

      The will be bye -laws in the gram panchayath to fix the property tax

      You need to submit your sale deed and Tax paid receipt and other title documents along with approvals copy

I heard that the registration of plots with this kind of plots (no DC conversion and no A-Khatha, no beterment charges paid) is stopped as of Oct 2nd week, 2010.

    Please advice whether it is true that the registration is topped for this kind of plots.

    My mother acquired a property under Registered GPA & a Registered Affidavit in 1983. She also applied for transfer of property to her name and got the Katha transfered to her name. She has also received a notice for payment of property tax. She expired in 1998, and her husband (my father) also expired in 2006. We are only two brothers as her legal heirs. Kindly advice further action to transfer the property to either brother. Thanks

    I bought Site (Registration happend) in the month of June,2010. The site comes under BBMP limits. Now I am planing to construct a house, but my problem here is I don’t have b-katha on my name and for house plan approval BBMP guys asking 15k because of b-katha is not there on my name.
    -> For house plan approval what are the documents do I need to provide?
    -> For house plan approval b-katha is nessecery?
    -> If I wanted B-katha on my name, do I need to apply for new one or do I need to apply for trasfer of b-katha from existing one?
    -> B-katha owner sold out that property to ‘X’ person and I bought from that ‘X’ person. ‘X’ person is not transfered or applyed for b-katha when he bought from b-katha owner. Now if I want b-katha on my name then how to proceed?

    Please clarify my doubts

    I have purchased a portion of a DC converted site in Kundanahalli village (Krishvi Orchid Woods layout) and it got registered in June 2010.

    The previous owner was having a khata for the entire site and betterment charges were not paid since BBMP was not accepting this.

    Now I want to get khata for my portion as I am planning to proceed with my house construction & hence need plan approval etc.

    if i pay the betterment charges(I seen in the paper soon bbmp will start collecting improvment charges for DC converted land ) will i get the khata transfer on my name.

    A 60X40 property was gifted to my mother and her sister by her father….. and the katha has been transferred in my mother’s name for her portion of 30×40…. Is bifurcation certificate required for plan sanction process, and if so how do we procure that???? It would be of great help if you can suggest your opinion??..
