Penalty clause is just to attract the buyer and there will be lots of reasons to justify the delay by the builder, almost ready by their legal team.You can take legal help for any penalty clause on your apartment's agreement and exercise your rights.
The builders do not have a proper reply to this querry. Besides , the possession is delayed.

I feel you need to contact statutory body like Kolkata Municipal Corporation for knowing the current status on the concrete road. As far as anything related to apartment is concerned, only builders can answer that.
