Guidelines for Uniformity and Easy Registration of Property
Property registration has become easy and there will be uniformity across the state. The discretionary powers given to sub-registrar have been removed. New guidelines have been issued which contains information on documents required for registration. Earlier property registration was one of the complex tasks but now the process has been made uniform and simple.
Revenue department has issued guidelines to sub-registrar on the documents required for registration of property. Guidelines include instructions from Karnataka Information Commission to the Inspector General of Stamps and Registrations and the Revenue Department. Guidelines will help citizens to register property easily preventing haphazard growth of cities. Bringing uniformity in registration process puts a check on registration of properties without proper documents.
Documents required for registration:
The property coming under jurisdiction of BBMP (Bruhat Bangaluru Mahanagara Palike), gram panchayat, town panchayat, municipalities and municipal councils or any corporation in the state requires six important documents. The lists of documents required are as follows.
1. Khata and tax determination receipt issued by BBMP or corporation,
2. An affidavit,
3. Sanction plan or Conversion certificate, if the property is on converted land,
4. Title deed or allotment order or possession certificate or sales document, if property is given by government department or agencies,
5. PAN issued by Income Tax Department or Form 60 and 61 if the property values more than 5 lakhs, and
6. Declaration in form 1 under the Karnataka Stamps Rules 1977. (Prevention of Undervaluation of property).
Documents required for registration of Agricultural Lands are as follows:
1. An Affidavit,
2. Declaration in form 1 under the Karnataka Stamps Rules 1977. (Prevention of Undervaluation of property),
3. RTC,
4. Declaration under Section 81-A of the Land Reforms Act,
5. Survey sketch of the land,
6. PAN issued by Income Tax Department, and
7. No Objection Certificate (NOC) from the appropriate authority under Section 6 of Karnataka SCs/STs Act, 1978 that prohibits sale of certain lands have to be submitted.

Uniform procedure across State. Discretionary powers of sub-registrars removed. Documents required for the purpose have been listed
Now registration of property is easy and there will be uniformity across the state. The new guidelines prevent harassing of citizens demanding for different documents while registering the property. Also the property without proper documents cannot be registered and will prevent haphazard growth of cities.

What does 50% undivided share in land means in registry if both the parties have the registry of same amount that is First party have 3 parts ownership in his propert and second party have 1 part in the same property.

I and my brother are planning to jointly buy a plot. For some reason the society from which are buying the plot cannot have joint members. So we plan to buy and register in my name. But both of us will have will pay equally towards the cost of the plot and both should have equal right. Later if we build or sell the plot, we will share the proceeds. How do we show this for Income tax purpose. Is it possible to show that both paid to buy the plot and share the revenue if any. Each of us want to show only our portion of investment and return to Income tax. How do we do this in a right way.

i am from Hyderabad and resident of QATAR, DOHA (MIDDLE EAST) since 3 years. My house is in Borabanda, Sanath Nagar PO. It is my father’s property and he wanted to transfer on my name. Once it is transferred to my name, i wanted get it register.
The plot consists of 2 storyed building with in 140 square yards.
basically this house is a notary based house (which we all called as PATTA house), not even regularized.
we are not paying any house tax/ property tax etc.,
we have only a current & water bills which we are paying around 28 years.
So Please clarify as below;

2. What will be the registration charges? Do they charge as per the no. of square yards / the house built in no. of square meters.?

I heard from several of my friends no legal check is required if a project is cleared by SBI bank as it scrutinizes all transactions for over 30 years extensively and exhaustively. Is is correct? I booked a flat in bangalore with a reputed builder by paying the booking amount in Oct/Nov.2006. The building was completed in July2009 and Occupancy certificate obtained in Oct.2009. I took possession immmediately after that and moved in March 2010. Because of some problem at the Government level none of the flats were registered in the name of buyers and now the builder has sent us a letter stating that all hurdles have been cleared and the registration process will start. The builder has given two options on the rate at which it can be registered to those who had purchased the flat before the occupancy certificate was issued by the BBMP. One is the Guidance value set by the government and the second on the total Purchase value which is more than the guidance value. Naturally the registration charges will be more for the second option. If option one is legal why should anyone opt for Option one.
sir, i have taken a flat i.e. 1 BHK in Tehran builders Bhiwadi (Hill view Garden). I have given the all documents which they want (like pan card, 4 photo & DD against Sub Registrar office Bhiwadi, cash money ) also i have signed all paper with thumb impression also. After that they told you can go. Your all paper is ok. so no need to go for registry. After one week they are calling me & saying your registery has been done. U can take the registry paper. I have bought a house in 2007.
I wanted to apply for Khata and at that time, somebody told me that:
1. Your house comes under a industrial layout (Notification of conversion of Agriculture to Industrial is there).
2. So, the building plan itself should have got rejected.
3. It is illegal to have residential house in an industrial layout.
4. So, BBMP will not issue a khata and also it will be very difficult for me to sell this property in future.
The area I am talking about is Jaraganahalli.
The place I am living, all the surroundings is residential houses only.
The notification was for silk industry and there is not a single such industry in the vicinity!
So, is it an illegal layout? Is it not possible to get a Khata or PID for this property?
Is it possible to get this property converted to residential now?

I have received an offer from a person for buying my property in Bangalore, but he is insisting on my producing the Absolute Sale Deed. I do not have the Absolute Sale Deed, as the original owner from whom I bought this property 40 years back was allotted this site by the City Improvement Trust (CIT) and no Absolute Sale Deed was drawn up between the original owner and the CIT. The original owner too is not available now. What should I do now to get an Absolute Sale Deed from the BDA/BBMP?

In your case you need to Visit the BBMP office (nearest – help center) and pay property tax, from next year onwards you can pay property online using last year application number.

My Name is Shankar and I have purchased a FLAT in Bangalore from builder XXX XXX
My agreement says only to pay 49,11,500/ + (Registration+STamp duty+
Maintenance Charges) out of which i have already disbursed 46,65,924/-
Now I am asking for registration of the flat and the builder is asking
to pay extra Govt. Levies@ 6.5% of 49,11,500 (i.e 3,19,248/-) which is
NO where menitoned in the agreement as well as Cost Break up sheet.
Also they are demanding late payment charges of 2,06,628/- which is
because disbursement got delayed from BANK for a month or two .At the time of agreement
based on our mutual understanding i applied for Home loan from SBI bank and the builder was aware that the disbursement would take some time and based on the trust i went forward with SBI Bank. I now feel that this was a trick because Till date they kept quite and when i asked them for registration, they are demanding extra money and saying
that the Land Value/Cement Value/Steel Value has gone up.
My Agreement was done – 21 st ,Jan, 2010
Actual Possession Date – Dec,2010 according to Sale Agreement
Current Situation – Not yet giving Possession Date.There are no amenities ready like swimming pool, lift, Gym, Club House, Parking Slot, Hi-FI DG set but the builder is also asking to pay Maintenance charges before doing the registration.
All disbursement Details done before JULY 2010 are Given Below:
2-Jan-2010- 2,00,000/- Cheque was given
17-Jan-2010- 3,00,000/- Cheque was given
12-Mar-2010- 22,00,000/- Disbursed by SBI Bank
31-July-2010- 75,924/- Disbursed by SBI Bank
31-July-2010- 18,90,000/- Disbursed by SBI Bank
I have been asking them to provide me with clarification on the govt.
charges (6.5%) but they are NOT responding to the email and phone
calls.
Please help me in this regard as this is a mental torture and my
personal and professional life is getting affected.

Registration Charges are separated into Two
1) Stamp Duty = 6.72% (BBMP Area)
2) Reg Fee = 1%
In case of delay in approval of Bank Loan, you can discuss and come to amicable settlement with the builder to avoid the interest

Can you tell me on what amount Registration & Stamp Duty was calculated for your flat?
was it on Rs. 49,11,500 or reduced amount? if it was reduced amount then while asking for last loan payment from SBI, did SBI object to the reduced amount in the registration & stamp duty?
