How to form an apartment owner’s association in Ghaziabad?
Apartment associations have become a major part of an apartment’s functioning in every city, be it Tier I, Tier II or Tier III cities. An apartment association is an authority that protects the rights of the apartment owners, maintains the amenities in the apartment and works for the welfare of the residents.

An apartment association in Ghaziabad should be filed under the UP Apartment Act, 2010. The Act contains provisions meant for welfare of owners of housing units in residential societies. It is mandatory that an apartment society should be registered to enjoy all the legal benefits. There should be at least seven or more members to form an apartment owner’s association. To form an apartment owner’s association:
The key officer of the association will be the president followed by a vice-president, a secretary and a treasurer. These officials will be elected by the Board of Manager. However, the board will also appoint the Assistant Treasurer and an Assistant Secretary. The officers of the association will be elected by the board of members on an annual basis. The apartment owners form the members of the association and are a general body. The management committee represents association before all official and non-official bodies concerning building and other member’s rights and interests.
What are the duties and powers of an AOA in Ghaziabad?
The president:
As per the members’ votes a society member will be elected as the president of the society. His duties would be to sue or defend any legal actions against the association. The president should also ensure the income and expenses of association for the welfare of the members. He will also enter into contracts approved or assigned by the committee.
The Secretary:
A secretary in an apartment association will organize and conduct the general body meeting of association members. He will also attend meetings representing the association and taking down the minutes of meeting. Information and problems of other members will be noted and analyzed by the secretary.
The treasurer:
A treasurer in an apartment society maintains funds and documents relating to association in safe custody. He also operates income and expenses of association empowered to operate bank accounts of association. Maintenance of petty cash to meet the apartment expenses is also looked after by the treasurer.
The Management Committee:
A management committee organizes social, cultural and recreational facilities for the members or people in the apartment. It represents members of association and protects rights and interests. They open and maintain bank accounts of association and work for the welfare of residents in association and co-operate with other associations for common and mutual benefits. They also ensure the generated amount is used for the maintenance of building and promote charitable feeling among members. A management committee also encourages religious, social, cultural and educational activities and maintains a safe custody of documents relating to land and buildings, license issued etc.
The members:
The apartment owners are the members of the apartment association and are obliged to attend the general body meeting and vote for the committee. The members also pour out their issues and pay the dues decided by the general body and abide by the bylaws.
