Key Features of Society Registration Maharashtra Rules 1971
Memorandum of Association: The memorandum of association of any society seeking registration under the Society Registration act must contain the following declaration as quoted. “We, the following persons, being desirous of forming ourselves into a society under the Societies Registration Act, 1860, have subscribed our names of this memorandum”.
Maintenance of accounts: The governing body of each society must keep all accounts, receipts, payments and list of movable and immovable property up to date. The society accounts must contain all particulars as per the Registrar of societies as per the law schedules.
Audit: The society must provide all audit reports including rules and regulation list. Certified copies of memorandum of association and other financial records as per the demand of the Registrar or the Assistant Registrar. The governing body or any individual in possession of the above mentioned documents can be asked to appear before the registrar or assistant registrar in person as deemed.
Manner of Audit: The manner of audit for every society registered under the societies act must be performed as per audit rules in accordance with the provisions of the Act. Receipts and disbursements, cash balance and vouchers must all be clearly shown in the audit report. Any inventory must be certified by the secretary f movables of the society. List of all members must be up to date along with maintenance of minutes of the genera body meeting. Any matter that the auditor may deem unsatisfactory can be brought to the notice of the registrar by the auditor.
Time Limit for Audit Submission: The governing body of the society must get all accounts audited within a period of six months of the date of balancing the accounts. The auditor must forward his or her report to the assistant registrar in not more than fifteen days.
Grant of Document Copies: on payment of the fee of Rs. 50 as specified under the Society Registration Maharashtra Rules 1971, the assistant registrar will make public certified copies of the account, audit report or any other document pertaining to the society files under the act.
Maintenance of List of Members: Every governing body of a society registered under the Act shall maintain a list of members within the meaning of section 15 in the Form of Schedule VI.
