Do builder have rights to construction/modify in common areas/terrace in a flat community?

Q: After construction completion and handing over the entire projects in a flat complex do the builder have any rights to construct a Pent house/s and install Display Board on the terrace at their cost? As per my knowledge the authority for any such actions on common areas will be to the registered society only.

I too remember the same, cos when I was staying in mumbai building society was having full control over the appartment. Here when I approached the builder in their MEMORANDUM OF AGREEMENT its mentioned that
"The PURCHASER hereby agrees that they will not have any claim or objection in constructing a Pent house/s and installing Display Board on the terrace by the Builder at their cost"

I dont know why they have included this in the agreement itself, its not only me all other buyers will be having the same, and many must have already signed. What can be done in this case?

As far as I know the builder do not have the right to construct or modify in common areas/terrace in a flat community. He have to take permission or written concern from the society.
