Are they in lease or per month rental agrrement? beacuse if in rent agrrement, that document might be there which can help you to file a case.

Hi Puneet, i have heard of legal notice under section 106 of TPA terminating the tenancy. You can send legal notice with the help of the local lawyer .In the notice do mention amount of rent being received and your bonafide need. You can take a decision on receiving the reply whether to go under DRC Act or TPA. Take the help of a lawyer in framing the contents of the notice.

Evicting a tenant is at time a head ache but at times we have to face such situations. You must follow the proper eviction rules. Speak to him first with a genuine reason and if he is not agreeing, file a suit with the help of a local lawyer. At the same time a reluctant tenant can be forcibly evicted with the help of the police, if he fails to vacate the house within the deadline given from the court. However before proceeding with the eviction process, you should consult the local lawyer for clarifications regarding the eviction laws that prevail in your city.

Hi Puneet i like the anwer of Sunil Sharma although keep in mind that during this process you are not allowed to perform any illegal actions against them like encroachment. In case if the tenant is not ready to vacate, you can file a criminal case as well as a civil case against him. You can seek the help of a local lawyer to send the notice requesting to vacate the premises within a given time.

For evicting a tenant, first you should have valid reasons. You should follow the local laws regarding eviction procedures. Give the tenant a written notice with enough time. If the tenant is not ready to move even after getting a court notice, you can file a lawsuit to evict your tenant.
