Change in ownership name

Q: Dear All,
My parents passed away about 2 years ago. And now I need to put the property on my name. The shares certificate is already done. but the actual process, what do I need to do? This property is based in Panaji.

It can only be done if you have substantial proof to claim your inheritance. Documents required for the change of name in inherit property are an Affidavit, an affirmation of facts (death certificate of your mother), a photocopy of the birth certificate of urs, a copy of your identity proof - PAN Card, Rational Card, Aadhar Card, Passport, Driving License, and Voter Identity card.

Out of all the documents mentioned, I'm missing only the Rational Card and the Driving License. I'm hoping I'm in good shape to get it done. Oh! and the Affidavit...I'm assuming that will be from a notary/lawyer?

Hello Darryl,
No Outstanding Certificate for the premises may be required before you apply for the mutation of property. In case of inherited property, affidavit and the original Death Certificate (in case of death of property owner) along with last tax paid receipt, Attested copy of the sale transaction deed, No Objection Certificate will be required. You can submit the duly filled Mutation form with required document for the change of the title ownership. Mutation of property of enables the municipal authority to update their property tax record with right property owner and issue proper tax documents.

Hi Mark!
In regards to the affidavit and NOC, am I correct in assuming I need to get in touch with a lawyer for these two documents?
In regards to the sale transaction deed, I'm guessing that's the original sales papers for the apartment correct?

You have to make Mutation. Mutation means addition or deletion of names in existing Form 1 & xiv. A mutation is required whenever one wants to officially add or delete names from the title deeds of a property.
A Form i & xiv of a property provides details such as survey number, sub-division number, type of land, area of survey, and sub-division number, type of land, area of survey and sub-division number, tenants if any, co-owners, owners and other right holders.
