Q: Complaint against Avnish Director of ABA Builders Ltd ( Orange County , Indirapuram) for Breach of Trust & Cheating customers. He promised to give possession in March 2009 but after he is giving it after 1 year.
According to penalty clause he is suppose to pay Rs.5 per sq ft but he is saying that delay is because of some Environmental issue, of which he has arranged a fake certificate and has refused to compensate.
Also currently society is not in a condition to live. Bad Roads, most of the buildings are under construction...security issues, dust, building material...etc...if we don't take possession within one month we would be liable to pay Rs.7,000 per month. He is also demanding Rs.73,000 in the name of Miscellaneous charges (Rs.31,000), Electricity meter, Water connection, Gas line...He makes false promises at the time of booking...his staff is also rude with customers...

It is heard that the possession date has been again postponed and the builder plans to hand over the possession in Oct'11. Has anyone been there and seen the progress? I am based outside Delhi and am unable to visit teh site.

Ihave been to the site yesterday ,work is in progress but not sure about the posession in june 2011 as promised to us.Im also concerned as how many families are really going to shift this year if the posession is given on time?
Guys, This is surely a matter of serious concern....So many of us have invested in Olive County, Vasundhara, and after seeing the builder's attitude with Orange County's customers, we need to do something very proactive here and get united first, before it becomes too late....
The Olive county team has also promised similar penalty of Rs 5/sqft. As the construction is at a slow pace, it looks as if they will have to give penalty to almost every buyer. After hearing what happened at Orange county, the owners at Olive county have to unite against any such hegemony by the builder.
