The builder is not giving the interest due to late delivery of flat which they promised ( and it's also in agreement).
Q: Siddha Town is telling for last six months that they are going in to pay the cheque in a few days, but still have not done so. What can be done?
Delays can also happen if the developer is out of funds, or the bank is not ready to finance his project. In both cases one can fight the case in a consumer court without hiring a lawyer, if the evidence is strong and can be proven.
Hi, A delay in giving possession can be due to various reasons such as pending municipal approvals or some dispute. Or if property prices are rising, the developer may deliberately not give possession in the hope of making buyers pay more even if the agreement has been signed at older rates. This will not reflect in the sale agreement.
I suggest we all go to the main office of Siddha town at Park Street and meet with Sanjay Jain and Siddharth Sethia to discuss our matter n concern. I m the owner of one flat here too, I paid for the garden facing but after possession there are NO GARDEN as promised.
HI, It is advisable to send a protest note to get the procession of the Flat. if you raise dispute with him now he will not deliver the flat and it will result in huge monitory loss to you.
Once you are in possession of the flat you can approach the Consumer forum for seeking relief.

Hi Jayanta, This is not the right time for you to take any legal action before get possession of your property. If you raise dispute with him now he will not deliver the flat and it will result in huge monitory loss to you. Hello Banerji and Rahul, I am eager to know what kind of action you are taking or have taken? I am also facing a similar kind of problem, I am supposed to get a lump sum money back from them for another cause, but not got it yet. And also they promised to pay money verbally to me for late handover issue during flat booking, but surprised to find nothing in the papers. Do you have the clause in your documents?
Hi I own a Flat at Siddha Town and as per the agreement I was suppose to get the possession on June 2012, if 6 months delay taken into consideration then the date has been crossed i.e December 2012. I mailed them stating that they should give me interest on my investment for the rest months. But didnt got any reply for that mail. Even I went to their office at 99A park street and had a words with customer care manager about it. She asked me to mail her again and I did, but yet I am waiting for her reply. I called her up lots of time but most of the time she were in meeting and talked to her once or twice she said she will be reverting my mail. Still waiting for my handover of my flat.
Hi..i think you should take legal advice. Is this the case with all builders..?? What do they think about this matter..?? have you discussed this matter with other owners.??
Hello Banerji..if something is promised on papers then you can drag the builder in court. You should initially give him legal notices and warnings and then take some serious action.
