Can a GPA CUM AGREEMENT OF SALE property be gifted to blood relation.
Q: My father expired without getting the property registered. The property is on GPA CUM AGREEMENT OF SALE with acknowledgement of full payment. Registration not completed.
My father had written a will conveying the right of ownership to my mother. Now can she gift the property to me.
Hi Kiran..in legal terms..probate is a court process by which a Will is proved valid or invalid. The legal process wherein the estate of a decedent is administered.
Hi Kian..as far as i know.. GPA registeration and sale through it is banned in India. This means that you cannot register the property but it gives you the right to transfer that property. And yes you can gift such property via a gift deed or a will from ur parenrs and register it and after probate it.
Hey Kiran..yes she can..to be more precise..gifting a property is valid if all documents are stamped and registered as required, and attested by two witnesses. If you do not register the gift deed, the gift is considered invalid.
Hi Kiran..Under the section 122 of the Transfer of Property Act, 1882, you can transfer immovable property through a gift deed. But first of all the property should be registered in the name of your mother. Then she can gift you.
