I want to sale my 1rk flat in bhayander e.

Q: i want to sale my 1rk flat in bhayander e,my society is reg society,i have share certificate,i hve paid stamp duty in year1992 but due to family problems reg delayed and builder refuses to help me right now. what process to be done? pl advice

According to Maharashtra inspector-general of registration (IGR), if owners delay the registrations of their properties by more than eight months, they will have to pay the stamp duty according to the current market value and not going by the rates prevalent at the time of purchase.

As per Section 49 of the Indian Registration Act, 1908, in case of a delay, you can request the district registrar to grant you an extension of another four months.

However, you will have to pay a penalty of up to 10 times the registration fee. "Usually, the penalty levied is 100-300% of the registration amount, but it can go up to the maximum amount too

Hi Nilesh, the only possible way is to register your flat now.. The biggest hurdle that you will face now is that the registration charge and stamp duty will be levied on the current value of your house.. Also, you have to pay a hefty fine for the delay.. if you fail to register within time, then the developer will be considered the legal and rightful owner.
