LBT reimbursement if Agreement to Sale is done before 31 March 2013 and if Sale deed is done after March 2013

Q: I hve purchased 2bhk flat in kharadi pune. I have done agreement to sell in March 2013. At that time i paid all stamp duty and registy charges. Later when I did my Sale deed in April 2014 I was demanded 1% LBT .I paid that amount as well. But Later during the year I heard a news that some lawyer has filed a case and won the case mentioning that LBT of people in all such similar cases will be returned by Corporation. Is this true? Can someone help me with the procedure to claim the LBT?

Hi Swapnil,
Any dealer who brings goods into city limits for use, consumption or sale therein is liable to pay LBT. The term dealer has been defined in the Act. Rates of LBT are given in Schedule A and vary from city
to city. For example, in Pune the rates of LBT range between (0.1 - 8)%; though the rate in case of most of the products is 4%.

LBT regulation provides for refund/ drawback at ninety per cent of LBT paid in case goods imported from outside city limits are moved out without “consumption, use or sale within city.

A dealer who is regularly importing and re-exporting goods, specified in Schedule A, may obtain prior permission from the Commissioner to pay only 10% of the LBT to avoid claim of refund.
