The Calcutta High Court shot down ITC's petition challenging construction of the city's tallest skyscraper on 42B.

ITC owns the Fountain Court property, which is also home to the some of the company's top officials including Chairman YC Deveshwar. Such kind of suits may have been filed earlier in our country but they are few and far between. It is due to lack of systemize law or too many case laws to fall back on.

And the project is being developed by a association of 4 real estate players -Mani Group, Alcove Realty and Diamond Group from Kolkata, and Sattva group from Bangalore.
While Fox & Mandal were solicitors to the developers, Chowringhee Residency, Victor Moses & Co were solicitors to ITC Ltd.

Though the a super-luxury residential skyscraper's height will be equivalent to an 80-storied building, The 42 will be 62 stories tall, housing 58 bungalow apartments piled up one over the other. The first 4 stories will make up the lobby and 3 service floors.

In 2013, ITC challenged the construction of The 42 under "easement right". The company had filed a civil suit in high court against the developers of The 42, claiming that ITC's right to receive light and air will be breach by the residential building being constructed to the west of its Fountain Court property on Little Russell Street in Kolkata.

Calcutta High Court decline ITC's petition in opposition to construction of city's tallest skyscraper on 42B at Chowringhee Road. The court said ITC has failed to make out a prima facie case for grant of directive to the proposed 245-mtrs vertical structure name, The 42, and noticed that such an order would be harsh.
