Well Lokesh, I would like to tell you that there were 6 buildings which were constructed by Cidco 3 decades ago. NMMC served a notice to petitioner to demolish the said buildings, alleging that they were dangerous. The association requested Cidco to grant NOC for redevelopment of the remaining 3 buildings, as 3 had been redeveloped. But CIDCO did not give the NOC, encouraging the association to move court.
Do you know Puneet? The flat owners have fighting the case for the last two-and-half years and finally their appeal has been heard. When they had approached NMMC for permission to carry out redevelopment of their Cidco-built buildings, which were declared dangerous, the officials asked them to get NOC from Cidco. But Cidco had refused to issue NOC and they had to go to court.
Yes Lokesh, And the court has given Cidco a month's time from its order dated January 14, 2015 to issue NOC. The court also ordered the civic body to process the petitioner's application for grant of development permission in two months from January 14, if Cidco fails to issue the NOC.
I think Puneet this will also clear the problem for redevelopment of over 1.20 lakh Cidco-built flats in areas under civic jurisdiction. The court disposed of the writ petition filed by JN3 Apartment Owners Association and directed that Cidco must take appropriate decision on the petitioner's application, dated August 9, 2012. the town planning has been asked to determine if there is any lease premium to be paid by the petitioner before issuing NOC.
The Bombay High Court recently allowed the residents of three JN3-type shabby buildings in Vashi to go ahead with their redevelopment plans. The court disallow City and Industrial Development Corporation's (Cidco) stay order on the redevelopment.
