What is the procedure for converting the use of residential house into commercial? To whom I have to take approval?

Hi Anuj, There is no legal procedure for converting residential house into commercial usage but you must have to take necessary approval from different authorities:
1. approvals from the housing society are required.
2. permission from the local municipal authorities.
3. For tenants, a no-objection statement from the landlord is mandatory in addition to normal approvals.

Very interesting insights but i would like to add that there is no specific provision for conversion of the use of flat from residential to commercial. One can use the flat for the commercial purpose provided, no production or manufacturing activity is conducted and the commercial use shall be completely professional in nature. In addition, it should not cause nuisance to other dwellers of the society.

Hi Rubiya, chartered accountants, lawyers, doctors and Services by resident advocates are some of the approved commercial activities in any residential area.Additionally, the dual usage of space is also allowed for tutorials, dance and yoga classes but before set up this commercial activity he must have to register with the housing society and local authorities.

Hi Mukund, I think commercial use of a residential flat is opposed by co-operative housing societies. That said, utilizing 20% of the space in a residential flat is legally permissible as long as the business in question falls within certain categories.

Hi Rajiv, I think you are right and it is certainly necessary to get the approval of the housing society in a general body before using a residential flat for commercial purposes. Depending on the nature of the business and also subject to the approval of the housing society, it may also be necessary to obtain permission from the local municipal authorities for conversion of the flat into a commercial establishment.

Contact the local property tax authorities in your local body/municipal office and request them to convert it to residential to commercial. They will do it by revising the property tax. The tarrif for commercial is two times comparing residential.
