Hi, the builder has delayed by 4+ years.

Q: They have handed over about 75% of the flats over last 2 years. They are not handing over the project and common areas. Now they are asking for additional maint charge without giving any accounts of the one year maint they have collected. Want to make maint their business. Kindly suggest what can be done.

I booked flat in Aditya Imperial heights in 2011 and paid 100% of flat cost at the time of flat booking entered in to agreement of sale(AOS) with delivery period of flat on 05-05-2013, including grace period, with payment of monthly rent of Rs 15000/, if flat is delayed to deliver as agreed. Till now neither the flat is delivered nor the monthly rent is paid, and not replying to any type of correspondence from my side, including Mails, Registered letters, SMSs, and if you go to office they will not give appointment saying prior appointment is required, if you ask for prior appointment they are saying wait , even after months are passing. All employees says they can not take decision, and file is pending with management. This is the fate of so called owners booked flats in ADITYA IMPERIAL HEIGHTS. I n my opinion they can complete the project in about 12 to 18 months time ,if the work in the present speed in work. If Aditya answer to this at least in this form it will help all.

You should consult with a reputed lawyer to know about the legal aspects in this matter and file complain against the builder if he is not ready to give proper information.

Any person can file a complaint against the builder, developer, housing with the consumer court under the following circumstances....
1. Delivered a house that does not comply with the specifications agreed upon.
2. Did not provide for free parking space within the compound / complex.
3. Charged higher than agreed amount.
4. Did not form co-operative housing society and handed it over to its members.
5. Did not provide for water storage tank.
6. Did not give a receipt against the paid amount.
7. Delivered a poor quality construction.
8. Did not deliver the house within the agreed time limit. If time limit not mentioned, it is assumed that the construction will be finished within maximum of 2 years from the date of start of work.
9. Did not give accounts for the expenses against which the builder has collected money, i.e. maintenance, electrical installations (transformer), etc.

Hello Pankaj, I can understand your concern. I would like to suggest you to have a thorough discussion with your builder and ask for the valid reason and structured plan for maintenance charges that they are charging. Also, you can consult a reputed lawyer to know about the legal aspects of the property and what is mentioned in your property agreement.
