Disappointment to DLF in Park Place Case

Q: In a brake to real estate major DLF, the Supreme Court on Monday abandoned its earlier order that obstructed the Punjab and Haryana High Court.

The Supreme Court bench observed that stay of proceedings is unjustified. DLF has a stay in its favor. And HC proceedings are also stayed. Both things cant go on."

Nice judgment. The Supreme Court direction can help the HC in deciding the rights of the allottees and could risk the interests of persons who have invested in Crest if the same is found to be illegal.

Yes, a bench headed by Justice TS Thakur while releasing its June 2013 order told that they didn't see any reason to prevent the HC from hearing the main petition. They express no opinion on the merits of the case and the HC should make an effort to speed up the hearing.

The company is facing so many troubles last few years. Though, the Supreme court did not vacate the stay on the HC's interim order that obstruct the company from construction, sale and marketing of its "The Crest" project. The builder is still free to sell its properties.
