Builder not providing STAMP DUTY FREE As promised while booking

Q: Swami Developer Builder Survey no 245/2b ,216,217 at New Panvel Site at Shivkar confirmed Stamp Duty registration Free , DHFL was marketing partner .while booking the dhfl exetutive confirmed that stamp duty registration is free is 20 % payment is made within one month time of flat cost in Jan 2014. Now till Nov 2015 there is not works started as Swami developers has to get all approvals cleared from CIDOC . Now Swami developers says that stamp duty has to be paid by me. While booking he mentioned all Legal charges Free on Receipt provided. Please let me know what can be done in such a case against Builder. I am vinay K form Mumbai Goregaon . Please Suggest.

Hi Vinay,
You bought flat from builder not from worker. Every decision related to project taken by the builder. So, without builders knowledge, it is not possible. Did you talk with the other owners of the flat? You are the only who facing the issue or few more having the same issue.

I think you should consult with a property lawyer with the first receipt of payment. See, what he says then proceed accordingly.

Did the builder stop booking in absence of worker? I am sure builder knows everything. Put pressure on him.

Hi all,
I think you both are right. If builder has given you any written documents or if it is mentioned in brochure then you can file a case in consumer redressel forum for deficiency in service.

First of all, you have to send legal notice to him to provide you stamp duty free registration. He is bound to give you if you have any written evidence. Builder can't mislead the customers by false promises he will be penalize for that.

Was there a written document provided to you regarding the Stamp duty free registration? If not there isn't much you can do, maybe consumer court. But if there is a written document you could take legal action. Also stamp duty is hardly ever excused, so it sounds a bit fishy.

Yes, if you have any proof which indicate that builder has promised you stamp duty free registration then you can take a legal action otherwise it is very difficult to get. It only happen with you or with all the buyers. Had they mentioned it in brochure?

The first receipt of payment which was proicvided to me mentioned All Legal charges free . Later when payment was cleared he gave a Receipt with Revenue stamp signed labelling as "SKIM 1" . when asked the builder at that time he said "SKIM 1 " means all charges free" Only the cost of the flat will be considered. Today after 2 years all those working earlier have left Builder and joined else where. Hence the builder claims \states that those who were working earlier made some false commitements to our customers. When I try to concat some of them who have left , one of them says there was a scheme where if a customer books before a period he gets Stamp Duty Registration Free. This is in may case.
