Q: After Unitech, home buyers are taking legal path against fraud builders and their delay projects.

It is true and now builders need to understand the processes of production of real estate and focus on it and only then they will deliver on time. Consumers want the final product, on time, and today they are willing to go to any lengths to challenge it.

Hi,
I think this can be a wake-up call of sorts. The writing on the wall is clear for them deliver on their promises and also deal their customers with care. In fact, many developers agree that they need to change the way they deal with home buyers. And the buyers should come forward and file complaint against such developers. In recent months, many cases have been filed against builders across the country.

Right Deepankar,
As per advocate Sushil Kaushik, who is fighting many cases on behalf of buyers in different Unitech projects, said home buyers just want their homes they have paid for and for that they are willing to go to any lengths today, even to the Supreme Court.

Earlier, it was saying that builders have the money and the muscle power. Now that mindset has changed and the buyers are more aware about forums which they can approach to get justice. Recently, the district administration in Gurgaon has formed the Gurgaon Arbitration Council to sort out pending real estate disputes in a fast track manner.

As per recenty data, around a third of more than 25 lakh apartments that were launched between 2008 and 2014 were delayed by at least one year. In the National Capital Region, which includes Delhi and adjoining areas such as Gurgaon and Noida, over 1.6 lakh homes were delayed between 12 and 24 months. In the Mumbai Metropolitan Region, around 1 lakh homes were delayed between 18 and 24 months.

As they can see that courts, state governments, as well as the centre with its proposed real estate regulatory bill taking a strong view on cases of cheating, fraud, delays in delivery against builders.

And recently they have seen the Unitech case, where its chairman, two managing directors and a director had to spend a night in jail, and bold actions from the National Consumer Disputes Redressal Commission against different builders have come as a kind of confidence booster for home buyers who have been fighting builders in different forums.
