Consumer forum sentenced 3 yrs jail term to Unitech chairman Ramesh Chandra and its 2 MDs

Q: The Consumer Disputes Redressal Commission is saying that Chandra, managing directors Sanjay Chandra and Ajay Chandra will serve 3 yrs each in jail and pay a fine of Rs 10000 each.

At the same time, the commission asked Unitech to pay Rs 1.5 lakh for causing mental agony and physical harassment to the complainants as well as hike in prices, and Rs 20000 as cost of legal action.

And Unitech failed to execute with the commission's order after which the complainants approached the commission again. Unitech then gave the complainants a cheque for Rs 10 lakh. The complainants, however, said the company still owed them Rs 6286220. Unitech then gave an undertaking that it will pay Rs 10 lakh every month starting August 2015. In September, the complainants filed another application, saying the company has not obeyed to the commission's earlier order.

What a mess up....to discharge its liability, Unitech handed over two chequesfor Rs 5259625 and Rs 34845 to the complainants. It also handed over a cheque for Rs 239480. But only one of these chequesfor Rs 34845was honored.

Now, in an order passed on Monday, the commission noted that Unitech failed to obey the undertaking given to it. The judgment debtors appear to be thick-skinned persons. They have no fear of law. Their intention is not to abide by the orders of this commission, which is very clear and apparent from the earlier facts. Under such circumstances, no option is left, except to order imprisonment of all the 3 person.

As ii know, On January 21 last year, The Consumer Disputes Redressal Commission ordered Unitech to refund Rs 4161383 to Singh and other complainants for its failure to deliver residential apartments in its Gardens project at Uniworld City in Sector 97 of Mohali.
