Supreme Court has suggested penalty of Rs. 50000 a day on builders for pollution

Q: The Supreme Court has suggested that building activity can be stopped if builders failed to undertake minimum dust checking measures such as spraying water.

Yes, it's a good idea. And the court is not in mood to extend the date of implementation of the more strict BS VI norms for all automakers from April 2020 in the face of a government protest against such a move.

While I definitely like the idea and support it. Do you think that there will be proper implementation? Builders have always been notoriously known to escape the clutches of the law. Is there a framework in place to suggest that this will be any different from previous attempts?

And the court issued a notice in this matter to NTPC, asking the state-run power producer why its Badarpur thermal power plant may not be shut down as demanded by the Delhi government. The court listed for hearing on February 18 the application by car makers for relaxing the ban on registration of diesel vehicles below 2000 cc.

We all hope so that this budget will bring some strict rule for the developers to stop such activities. And we can see that lot's of developers all across the nation are arresting and fined them. Legal bodies are also taking strict actions. State govt become very strict towards the local body's activities.

You can see that courts, state governments, as well as the centre with its proposed real estate regulatory bill taking a strong view on cases of cheating, fraud, delays in delivery against builders.

This is definitely a welcome change! Pollution levels have been getting out of hand in the metro cities. Increased congestion and pollution are also accompanied with depleting environment and green spaces. After repeated requests by the government which have been ignored by the builders, it seems like this penalty is the final resort to help improve the current situation.

It is a clear cut order by SC and asked pollution control boards to consider surprise checks on building sites to check dust related pollution levels during construction work. And if the builders fail to keep pollution levels at the minimum charges a penalty of Rs.50000 a day.

Hi Pranab,
In this way they could stop the pollution level in the state as well. A bench comprising Chief Justice of India TS Thakur and R Bhanumathi also suggested that the government phase out all diesel vehicles which are more than 5 yrs old.
