Kolhapur areas have exempted from maximum TDR use clause
Q: The state government issued a notification last week exempting old city areas from area-based restrictions on the utilization of transfer development rights.
Yes, in the earlier notification issued on January 28, the state government had restricted the utilisation of TDR based on the land size and the road width on any plot. However, the government issued a notification last week stating that specific area-based restriction on the maximum permissible limit prescribed by earlier regulations shall remain in force except for Gaothan areas.
But now the state government has drafted the rules based on the earlier development control rules (DCR), which, for the first time categorised land plots and road width for TDR utilization.
You are right Himani. And i believe that the clause of maximum permissible area will be helpful help at only two places in the city i.e. Rajarampuri main road and the road along Dabholkar Corner to Tararani Chowk. It will not be helpful at other places, as the FSI granted is already higher.
But what i think is that the change is not significant as the basic objection to the categorisation of TDR loading is still not addressed. As a result, the builders will be at loss.
But if we take the expert and developers advice, they claimed that the change will not help reducing congestion in old city areas? What is your suggestion? Do you think that it will help in any manner?
Hi Himani, Very frankly speakin, the plot sizes in the Gaothan areas are already very small. The state has stopped the TDR facility for small sized lands. Thus, the execution of maximum utilization of TDR for Gaothan areas will not help the planning authorities achieve the intended result of decongesting such areas.
