Q: Hi, Myself Manish Kumar Gupta, resident of Sector N/1, Aliganj, Lucknow had booked 2 Bed Room + Study room unit on 18th Sept 2012 in Lucknow Sahara City Home project. My unit number is C20 / 501, Hardoi Bypass Road, Near IIM, Lucknow. I have took 30 Lacs loan from LIC for which I am paying approx. 33k every month to LIC, I have paid almost 95% payment to Sahara. I was expected to get possession on Oct 2014 but so far no possession has been offered. I had 100 of calls with Sahara Management people but no outcome so far, I already took the legal action against them but so far no progress, date after date I am getting from court, no meaningful action taken by court so far. It’s just getting postponed again and again due to various reason. Could anyone of you suggest more option what could be possible to get the possession from these cheater? Sahara chairman is jail almost 2 year, don’t know what to do and how to get my unit or my money back from these corrupt people? Please advise how I can build more pressure on them to handover my possession? Which are all government agencies where I can file complaint against them? I advise you to find out people from same project, make a whatsapp group, discuss with lawyer and file case in NCDRC, that's what we are doing for Sahara City Home Project.

Good Morning friends!!!!!1 The buyer can file a case in the consumer dispute redressal commission at the district, state and national level, depending on the property value or amount of damage suffered. For a property less than Rs 20 lakh, complaint can be filed in the District Commission in respective district. For property over Rs 20 lakh and less than a crore, it can be filed before the state commission and for property over Rs 1 crore it can be filed before the National Commission in New Delhi.
Hi Shreya, thanks for your reply, but as I said in my explanation that I have already filed case with Uttar Pradesh State Commission last year in Aug 15, but so far 8 month been passed and nothing been done except sending multiple reminder to Sahara People as they do not turn to court till now. I want to know if there is any other way except than court case which can help to build more pressure on them e.g. writing to particular Govt. authority or Police commissioner etc.
I think you should published in your local newspaper about this builder and their project. It will impact a lot to your developer as lot's of people will aware of this developer and nobody will buy or book any property from this builder.
Thanks Shreya for your reply, The builder which I am talk ing is Sahara India group, and they are already abused a lot because of Sahar SEBI ongoing fight, infract his chairman Subrato rai was in jail for more than 2 year, now he is out on bail, publishing in paper will not help at all as they are got lot of defame. Case is already going on consumer court but it very slow, don't know what else can be done to get money or property out from these culprit people.
Hi, One can fight the case in a consumer court without hiring a lawyer, if the evidence is strong and can be proven. Homebuyers can file a case jointly against the builder as per Section 12(1)(c) of the Consumer Protection Act, 1986, wherein they need to make the groups of buyer on the basis of payment plans opted for or similar reliefs/cause of action so that it becomes easy for the court/forum to decide the case of groups on the basis of one petition only.

If can suggest some other way as well go build more pressure on Sahara Prime City, Lucknow then please let me know.

The Tamil Nadu Consumer Protection Organisation took up the case of the investors.
As per SEBI report, Sahara purchased land at 103 cities at a cost of 177363.45 lakh. Except 10 cities (Lucknow, Indore, Nagpur, Coimbatore, Jaipur, Ahmedabad, Gwalior, Solapur, Aurangabad and Cochin), the township project did not started anywhere else.

same nature of issue with the Nagpur buyers. They are also waiting for their flat possession. A large part of the 106-acre project is incomplete even as bookings began in 2004, work has been continuing at a slow pace. The buyers have paid 75 to 90% of the dues. For those who have paid the entire amount, sale deed is not being drawn up. Recently, Sahara India had offered to give them possession while assuring sale deed would be registered later.
In Nagpur project, i heard that some investors have been demanding their money back but Sahara India is saying that 10% of the amount will be deducted.
And now they are replying that their boss Subrata Roy's arrest as the reason for the work not bringing back at Nagpur project that has really come to a break.
