If a builder constructs a house and give handover, if there is a pent house constructed whom does it belong to?

Q: Who should be the owner of pent house?builder or apartment members?

Does it not belong to the Apartment owners?

The builder will be the owner. But once he sell off the penthouse the concern person will be the owner of that pent house.
