Is NOC from all the legal heirs required to get property mutated?

Q: My father had a property in Kochi. After he expired, I along with my siblings got the property. I am thinking of selling it. But before that I need to mutate it. Is it required to take NOC from all my siblings to get property mutated?

Hi, recently I had hear that No NOC required to gain farmland for industrial use? Is it correct.. please throw some light in this point..

Yes victor you are right,
Revenue and agriculture department have announced that now onward no need to take a no-objection certificate (NOC) from the state government will no longer be required for acquiring agricultural land for industrial development.

Hey guys, I also read this news in newspaper besides the agriculture land rules, we will amend the regional and town planning act too, so agricultural land procurement for industrial development will be hassle-free.

Yes, a NOC would be required before mutating a property. Mutation is the entry of all the new details associated with the property like new owner, area of the property, type of property, whether residential or commercial, etc. Mututation entries are essential to discover whether the property had a clear title. However before mutating the details you need to get a NOC from all the legal heirs of the property so that they do not have an objection afterwards. You might have to produce the will that your father left.

An NOC is a No Objection Certificate to mortgage the property given by the legal owner of the property to the Bank. It is not required for NOC from all the heirs but if whenever asked then you have to produce it.
