Tamilnadu apartments rule and regulation.

Q: We are living in HIG flats in Chennai. We want to know about the action plan of residence owner of these flats.

Dear sir, we are living in an apartment for the past 6 years. In our apartment, well water and borewell is available. Now there is no water in well. In borewell the water is littlebit salty. But we are ready to use the borewell. But one of my flat owner is saying to take a new borewell. And asking money to share all other owners. But we are not interested for doing a new borewell. We are ready to use current Borewell. But the other owner not allowing us to switch on the motor. He locked our pipeline too. Shall we keep a separate syntex tank for my flat and connect it to existing pipeline? Please advice.

Hi,i am tenant in a gated community apartment in omr, .i am paying my maintenance charges regularly, but i,m not allowed to use swimming pool even for my child. The assn says only owners has access to gym and s,pool and tenants have to pay extra rs500/ per person to enjoy such facilities .please advice me on issue. Gajapathy, chennai. 2nd oct 2014

Dear Sir.. In our apartment, we don't have formed any association. One of tenant is misusing terrace as they have cut the pipe from water tank and connected Tab. Daily they are washing and cleaning their cloths in terrace only. The terrace looks like white area due to detergents. they are not hear anything, if we ask to not do that.. Need your advice whether it can be preventable.If Yes, where should we have to complaint against them.

Sir, My TV Media Friends who came to my flat to shoot a cooking programme was not permitted by the Association.Initially
they told me to give a written letter but again they asked me to pay them Rs 4,000.
Also they were insulted by the Association People saying some reasons regarding security and hassles to other residents.
We decided not shoot even inside my flat and I have requested my friends to have a coffee or Tea in my flat
But they sent the securities and asked them to move out of my flat. Here the same association is letting Film shootings to take place in common area.
Will it wont be a hassle for other residents?. Is it something illegal to shoot just a cooking show within MY FLAT?
I accept seeking a permission as this involves security reason and other hassles but is it legal for them to ask for money to shoot within my own private flat. In this case I feel they least borthered about security and Hassles to others than money

If the leakings are creating problem to all the residents and it is present in the common area then the amount should be shared. If it is creating problem only to you then you should contribute. Please consult with the association once.

we r liveing in apartment fast 6+yrs in terace weathering course made 20yrs back major leakegsin my house we already in form association we made 15000 rs spend made new weathering this amount should be share or not kindly send ur advice

Hi Santhanam.. Common areas like garden, play area, community hall, staircase, terrace and elevators can be used by all occupants of the apartment.Anybody can get equal access to the amenities irrespective of the size of individual flats and it will mentioned in the sales deed. Any profit flowing from common space shall be put in the corpus fund or shared by the owners and, expenditures on account of maintenance too shall be divided among them. Repair, replacement, security and maintenance are the administrative responsibilities of the elected association.The cost of maintenance of reserved amenities such as covered parking, club house, gym, swimming pool, indoor games, theatre, etc, cannot be passed on to other owners who had not subscribed to these benefits. But it might differ from apartment to apartment. Kindly consult with your owner's association.
