Q: I heard that this property comes under Forest Land and investors may have to deal with court proceedings in future.

Hello All- I am planning to buy flat in prestige residency project, thane. Need to know if they have got OC & if there is any dispute of forest land pending. Any suggestions/comments from the existing residents would be of great help.

Hi,
Better visit the project site, see the construction status of the project with ur naked eyes, find out the realty whether the locality comes under forest zone or not. visit the developers office and ask for the legal documents, verify it by a property lawyer or local municipal. After getting the positive answer go ahead. After all it is a matter of ur hard earned money. Money once goes will never come easily.

I think kishore is right. You should check all the legal documents and approval first. Because, there are lot's of bad reviews in this project. It will be better for you if take the advice of a legal expert on it. If there is a land issue then visit the local municipal ask whether the locality comes under forest zone or not. Ask for the latest tax receipt, CC and IOD from the builder.

Mr. Kedia / Prescon Realtors of Prestige Residency, Prescon City has CHEATED. Committed a FRAUD by selling a flat booked by me to third party. This is how: I, Deepak H Pandya, booked a 2 bedroom ‘flat No. A – 1102’ on 11th floor, wing A in Gardenia, in Housing complex – Prestige Residency situated at Kavesar, behind Suraj water Park, Thane (west). It was booked way back in 6th May 2006 by paying 20% as booking amount, for which developers has issued receipts to me. 80% of the flat cost was being funded as Home loans. A Loan sanction letter was submitted to developer. Later, project was on hold due to FOREST LAND ISSUES. Post commencement of work, in 2012 developer demanded an unreasonable cost. As I found it much higher than the original price of Rs. 1749/- per sq. ft. for which I was ready to pay, I decided to take support of LAW. I filed a case in COSUMER FOROUM, ( Complain No. 237 / 2012 ) Thane, against M/s. Hopewell Builders / Prescon Builders.

Hi Ashish, I have also heard about the previous cases.. But bank has given me loan for this project and I feel now it is clear from all the past cases as banks wouldn't had given loans. Please other residents, share your reviews.

See if bank are giving loans on the property, so all legalities must have been checked by them, isn't it? However, i have heard in past cases, that even after possessions, court sometimes declares construction as illegal saying that it is on forest land. so that is my worry?

Ashish, there were news that Prestige Residency comes under a forest land but for your assurance before buying a property here, hire a home inspector or an independent property valuation agency who can look over the property. Be present during the property inspection. Check whether the property has been registered in an authorized department.
