Residents of Mysore ignorant about Non Occupancy charges to be paid by owners

Q: NOC charges to be paid by owners who rent out apartments. NOC is means of raising funds to augment the funds for maintenenace of the buildings. It is in vougue in cities like Mumbai.But in Mysore people are ignorant about this. Some Associations have tried to introduce but failed to get it passed by the General Body, for obvious reasons. Which of the Associations have adopted this mode of raising funds?

I do not agree with Mr Nagesh because NOC is not payable if the flat is locked and not sub-let.

I agree NOC is to be charged only when the apartment is rented out and the owner earns the rent.

I agree with Mr Murali the topic has been discussed for a long time and the confusion is still on. Why to pay Non Occupancy Charges? There has been argument even between the society and its members. On one hand societies think that they are doing justice by charging members for subletting their premises and on the other hand members feel that societies victimise the members by collecting extra charges when there is no difference whether the flat is being used by the owner or it is given for rent.

NOC is chargeable only when the General Body approves by a majority vote as per MOU of the Society (Association).

Are you telling me that the society is allowed to charge double maintenance from the owner and the owner as well as the tenant for the same. The concept of Non occupancy charges is wrong use of name or term. If the owner is not staying in his flat then also he is charged NOC and if somebody is occupying the flat then he is paying regular maintenance. This absolutelty injustice.

It is not double charge. True Noc is a misnomer but it has been in use for several years. NOC should not be charged the apartment is unoccupied and the owner is not earning rent.

@Murali, two year ago Mumbai High Court has already given due consideration over the Non Occupancy charges. Non occupancy charges cannot be called random charges as it is charged from the owner to protect and safeguard the interest of the socity members.

The NOC charges argument has been doing rounds for a while now. Even in Mumbai residents have been raising questions on the same. Are you saying just because there is a rule, apartments associations have to collect double maintenance from the owner and tenant for the same apartment. isn't that unfair?

It is not double charges. All charges are to be paid by owners. If the tenant is paying anything it is according to thed agreement between the tenant and the owner.
