Q: Hello all, I have purchased a Land loser site from MUDA 20 years back. I had not taken the Title deed at that time as they were not giving at that time.
Now I want to take the title deed. If anyone has taken Title deed kindly let me know the procedure for obtaining the same.
I am seeing that the fine amount is very high. Apart from that I wanted to know how much time it takes to obtain the same officially. Any inputs on the procedure will help.
Hi Original model house built by City Improvement Board, Mysore allotted to the allottee in 1968. The original allottee is no more. After his demise his legal heirs sold the property to my sister 1991. My sister gifted to me in 2019. But I found out that no where original title deed has been executed to allottee. Now that the deed needs to executed by MUDA (since the CITB, Mysore is now MUDA) . What will be the financial penalty (guidance value may be around Rs 80 lakhs of property. How long the complete process takes .

Madam, Swati Pashasia, I did quote your above observation that penalty clause shall kick in only when the site is sold without title deed. I told the case worker, site is not sold. It is under the possession of original Muda allotee, still he insisted that we have to pay penalty since we have not constructed the house. If house is constructed, no penalty would be leveid, he clarified
I met the concerned case worker in Muda. I was told that I need to pay penalty for getting the title deed. He says the penalty shall be 25% of the market value declared by subregistar. According to him it works out to Rs.5 lacs and odd. I told him that my wife has been the original owner and the site is in her possession till date. Upto date tax is paid. I read in news paper Muda had taken decision to issue title deeds after collecting penalty. It falls under 4 categories. My wife is the original allotee. Site is not sold. To get title deed for vacant site why she should pay penalty of Rs.5 lacs and odd?. Not clear. I was told people are paying this heafty penalty. Please clarify. Possession letter is issued by Muda during 1998. Katha is in her name. can we not make a legal document and register this as title deed, please advise.
Did you get the title deed from MUDA?. In my case, I am the original allottee. I have not sold the property to any one. I have original Katha and Possession letter issued by MUDA. To get the Title deed, there should not be any fine. Is that Ok?. Uma
You need to go and find out at MUDA. If you build the house then there will not be any fine. That was the rule. I don't know how it is now. It is better to go and check over there only. It varies from one site to another. I have not yet got mine as yet.
Yes, Copy of sale deed can be obtained from MUDA, Sub-registrar Office. The penalty clause kicks in only when the property without the title deed is sold to another party.
Procedure to obtain the title deed: 1) Obtain the title deed (kraya patra) request form, fill it out and provide all necessary documentation listed on the back of the form.
2) Submit the required documents to MUDA and obtain the acknowledgment
A caseworker is assigned based on the location of your property. Find out who he or she is and keep meeting her to get the status.
The usual nonsense you get from MUDA workers is that your file is not found! You have to bribe the file locator who is a lazy ass sitting in the secure corridor.
Once your file is located, your caseworker will have it with him/her and then you have to constantly pursue it for the status update.
Thanks Sheshagiri Mehta. I have already given the application. I could not follow up in between. It has been more than a year. Fine seems to be little high as per my research on the net. It is around 25% of the subregistrar's value of the plot. I have met the Tahasildar also. He is also useless. Only thing I have not done is meeting the commissioner. I am really not sure if it will back fire if I meet the commissioner. Because I cannot keep meeting the commissioner all the time and work has to be done by the case worker. Do they expect lot of bribe. I really don't know. If you have done it for your site kindly let me know how to approach those case workers. It is so difficult to deal with them. I asked him what is his fees also. Even then he is not opening his mouth.
Yes that is the case Swathi Pachasia. The seller has sold it to me without the Title deed. Now I need to get the Title deed in my name as the property belongs to me now. So I need to pay the penalty now.
Hello Pushpa, Please inquire with the concerned office for charges to get title deed. You can register property and on the basis of registered documents, you can get title deed.
You did not get my question. Title deed will be issued to the orignial allottee. If not taken at that time one has to pay heavy fine. That is the reason I am trying to find out the fee for the same. Concerned clerk is a cheat and he is not giving the correct information.
