5% VAT demand by builder

Q: I booked a flat in Amethyst in Nirmal Life Style in Mulund, Mumbai. Builder is asking to pay 5% VAT on agreement value which was registered in 2006. According to him there is a high court judgement in April 2012 vacating a stay on VAT payment that was imposed by Maharastra government and stayed by court earlier.Has any body else recd. such demand and is it correct on part of builder to ask for 5% VAT

Many builders are asking this . The issue should be taken up with Sales Tax department which is collecting this.
