Q: My concerned are as follows, in Surya Nagar Colony Phase 1 and Phase 2 Faridabad:-
1 - Is the second floor is legal?
2 - If yes then what should be the area of second floor as compared to the ground floor or first floor ?
As per the dealer and builder by mcf faridabad construction law
0 floor = 60% of the plot area
1 floor = 60% of the plot area
2 floor = 30% of the plot area
which is in total = 150 %
And the above are divided by the builder as :
0 floor = 50% of the plot area
0 floor = 50% of the plot area
2 floor = 50% of the plot area
which is also equal to 150% and they are saying it is legal.
So if in this case if I am buying second floor, would it be genuine or the HUDA will demolish my second floor.
It is simple builder floor in 200, 160 and 170 sq yrds and I saw the flat through a property dealer. He was saying that second floor is legal with 50%+50%+50% of area and was saying 80% loan is also available on the second floor with roof permit. If in future any clause comes for the construction for third floor then I can construct the third floor.
