Can i file FIR against builder?

Q: Hi All,

Since 6 months the builder is promising to refund money and he always delays in doing that,
Can I file a FIR against him? Please advice.

Hey, which is this project you are talking about?? Probably we will also take care and not invest in such projects.. However, what was the issue, which led you to leave the project and ask for refund?

This is a project in phursungi, pune. The reason i am cancelling is cause the builder is a big fraud and also the quality of construction sucks.
I had booked flat in 2010. The project started in 2008. Still now only 60% of work is done. For constructing the building he will take 3 more years i.e. total 7 years to build it.
Along with me soo many families are annoyed and frustrated and lot of them are cancelling.
Later we came to know he was using cheap material for construction also.
Surprisingly The builder is member of credai pune and has atleast 10 proejcts under his belt.

Please dont do mistake like i did. Before purchasing flat check the quality and commitment by builder. I was attracted with the price which he was offering. I am sure lot of guys did that and now we are suffering.

Hi.. You can file the case in consumer court or take legal help about the same.. If you scare him with a notice which has been prepared by a legal advisor, probably he can refund your money..

Well, thats the last option i have. Consumer court takes atleast 3 months and there is no limit on it. it can take a year also. Thats why I asked about FIR. Anyways thanx for the advice
