Q: Dear all, i invested in laxmi niwas project in april-2012 in installment. at the time of booking they made very promises, like registry and etc. I have made more than 43% of payment but no reply from the company instead of to make timely payment. I stop the payment, They only called me for the payment but if i asked them for the registry they told me to wait. I emailed them and told that cancelled my plot, but no response. Then i visited there small office, the staff with no knowledge of the company process, i told them either to take the all payment or cancell my plot and give my all the money back. The company director Mr. Ghanshyam (with very rude attitude) said that the amount you paid till now the 25% deduct and the money will refund also in installment. I was shocked. At that time i did not have any choice. I have a hard earned money. I requested you to all not to invest even a single paisa in these kind of pre launch projects.
I have also invested in same... Any progress... Because similar kind of situation has been faced by me! Full payment done but no response from builder.
I have also invested but after several attempts there is no response. I purchased a plot of 125 square yards.whenever i tried to ask them about the registry they just says that we will contact you but as of now they dint made a single attempt about the same theycalled me only when the payment was due or due date was nearby. I have made their full payment two years back as of now no one has contacted me about the registry. Now it seems that I have invested in wrong firm rather i would suggest everyone do not purchase from them.If anyone has some suggestion how to go legal with them please let me know about the same on my email ;- mydreamsemail@gmail.com.
Hi all, If there is a delay in possession after getting the full payment. According to the Registration Act, property agreements should be registered with the stamp duty and registration office within four months of the date of execution. In case of an emergency or a court case, another four months are given to register the documents.
But, during the extension period, the registration is done only on the payment of a penalty, not exceeding 10 times the amount of the registration fee.
As per company i was disappeard or a Chronic Defaulter, i asked this company did they ever mail me any letter or email me, i was continously followup the company for Proper documentation. And as per company i have a POOR FINANCIAL CONDITION : (Reply from my side) whenever the company want i show them my Form 16, FD,s and other properties paper. I have no regret what company did with me.. but i advice pls do check 1000 times before investing, after we all have the hard earned money. Apropos your above comments pls be apprised that you took a plan of payments in 12 Installments wherein you paid just 4 of them till August 2012. Thereafter you disappeared and have been a CHRONIC DEFAULTER.
Then after ONE YEAR you appeared with a NOTARY ATTESTED Requisition for Cancellation of plot and Refund of what ever little Amount Paid - citing your inability and poor financial conditions. Heeding to your request your all payments were refunded immediately on the same day as per company norms and you issued proper receipts with a note of satisfaction. The said documents are in record with the Company. Thereafter putting such an irresponsible, insensible and derogatory statements shall only invite a stern legal action against you. Your above comments are undoubtedly with certain malafide intentions and ulterior motives.

why registry not started after full payments. there is small office and no one is responsible for any response, all are saying call ghanshyam, he is outside.......now what to do.......for this type of act
Hello ajaz, I can understand your concern. I would like to suggest you to consult a reputed lawyer to know about the legal aspects of the order and what is mentioned in your property agreement.He will better guide you in this regards. Thanks.
Hi Ajaz, If owners delay the registrations of their properties by more than eight months, they will have to pay the stamp duty according to the current market value and not going by the rates prevalent at the time of purchase. The rule pertains to the sale, purchase or gift of land, flats or commercial offices.
Feeling guilty for you. Yea u r right so always invest in good companies their rates are high but atleast your money is safe and you will gate assured return..
