Who's liability is the property tax for individual flats new project for purpose of applying for CC & OC?
Q: The builder has made the buyers pay for p.tax for past years since booking the flats in 2011, and now states that unless all owners pay up the property tax, he cannot apply for OC. Some owners have not registered the sale deeds yet, and registering is cited as pre-requisite to pay property tax for individual flats. Is this true?
The Builder has to get the Occupancy certificate from the Municipal Corporation. It is a legal permission to sale the flat after which customers can buy and occupy them for living. If they do not have an occupancy certificate then the building is illegal. The builder has to submit a No Objection Certificate and Lift Safety certificate to get the Occupancy certificate.
As per my understanding, property tax has nothing to do with occupancy certificate. But to be on the safer side you can take help from the legal expert in this matter and do the needful.
