Q: Hi all,
Our builder is telling that there is hold on increase in guidance value till April 25th 2016. Thus he is suggesting us to get it registered before 25th.

But I am not sure whether there is hold or there will be hike from April 1st for sure.
Please help me by providing your inputs.
Latest Answer: Hello, But recently I read something online that BBMP has increased the Guidance value by 20% for owned building and 25% for commercial buildings effective from April 1, 2016.

Q: The builder has made the buyers pay for p.tax for past years since booking the flats in 2011, and now states that unless all owners pay up the property tax, he cannot apply for OC.
Some owners have not registered the sale deeds yet, and registering is cited as pre-requisite to pay property tax for individual flats. Is this true?

Latest Answer: The Builder has to get the Occupancy certificate from the Municipal Corporation. It is a legal permission to sale the flat after which customers can buy and occupy them for living. If they do not have an occupancy certificate then the building is illegal. The builder has to submit a No Objection Certificate and Lift Safety certificate to get the Occupancy certificate. As per my understanding, property tax has nothing to do with occupancy certificate. But to be on the safer side you can take help from the legal expert in this matter and do the needful.

Q: If the land is jointly developed by the land owner and the builder for apartments;while construction is still going on ,if the land owner goes for sale for his share ,can land owner collect VAT and SERVICE TAX from the buyer?
Latest Answer: If the land owner goes for sale for his share, that is you, then you and new buyer has to come up with mutual agreement between builder because in the future new buyer will have to deal with the builder. VAT and SERVICE TAX are applicable for sale of under-construction property but the builder has to collect the same and pay to govt. I would suggest, you discuss this with your builder to know and a legal expert for smooth closing of the deal.

Q: I am planning to purchase "Balaji Sunflower" 3 BHK flat.

AS per the properly dealer communication, The area where the construction is going on it is "A" Khata but when I will by the flat the it would be transfer individually with my name as "B" Khata. Please let me what is cause. Should I purchase this properly.
Latest Answer: The project is delayed by more than 2 years and still incomplete. There is an ongoing issue between the builder and the land owner regarding the entrance and the gate.
