Q: Builder got approval for 4 flats only from corporation. Ground floor for parking, 1st floor 2 flats, 2nd floor 2 flats. However, he constructed one more flat at ground floor, which is not in the approval. But I am buying the flat 2nd floor, but in future, if the corporation comes and find the ground floor, will they ask the builder / owner to demolish the full building or only the ground floor which is not in approval? Is this a legal problem or 2nd floor is not under risk? Is this project advisable to take or better to drop off? Need some legal or expert advice. Thanks
According to me, it is not safe to buy a property in this project as he has illegally constructed a flat in ground floor which was kept for parking. In this kind of projects you may face problem in the future if anything went wrong. Where the owners are going to keep their cars? Is the builder charging for car parking?
Since the builder has taken the approval for constructing flats only on first and second floor. It is illegal from the builder's side to go ahead with such construction. The builder have to take necessary approvals from the corporation and go ahead with the construction activities. You can also consult a legal advisor regarding this matter.
