Is commercial activity allowed in residential apartment?

Q: I have Residential property in Sec 46 Noida; Uttar Pradesh; where i have made a Basement. I understand that commercial activity is not allowed in residential apartment. If I start Yoga classes or Tuition classes or teaching activity (foreign language course), utilizing the Basement, will consider it as a commercial activity. What is the procedure of starting such classes in your own house?

What I feel that if the number of students are less than i do not think there will be any problem but if the number of your student increase it may hamper the privacy of the other residents staying in this complex. In that case you have to take permission from the apartment or housing society.

As you have clearly stated that starting a tuition or a yoga class in the basement becomes a commercial activity, since it is not allowed in residential apartment. But yes you can start a tuition, yoga or a dance class with taking prior permission from apartment owners association or housing society before starting the service. One may also need to obtain permission from civic authorities for converting the house into commercial establishment. Presently the rule says that 20% commercial activity is allowed in residential units. However it is still considered to be illegal and to be on safer side it is better to get a legal expertise.
