Buying Converted land

Q: Hi We are planning to buy a plot for construction of house. This land was converted from agricultral land around 1995 (before the 2008 act).
I already own a house and my wife is planning to buy this plot and build a house through mortgage. I came to know that wife cannot build a house in converted land if husband already owns a house elsewhere. Is it true ?

this is mostly true. Are you talking about Kerala Conservation of Paddy Land and Wetland Act, 2008? This law prevents one from reclamation of paddy fields and agricultural land so that it can solely be kept for agriculture. There is another act that was passed in 2005 that brings agricultural land on par with all property. This law even equalizes gender inequalities related to possession of agricultural land in India. On that front, it is mostly possible that your wife can own that converted property. Can you be more specific as to which Act exactly you're referring to?
