Request for Advice on Vanikaran Zone Land - Purchase and Sale.

Q: We are a group based out of Pune and are looking to invest in farmhouse plots in a scheme in Bhor (Kurunji Village). We had the deal almost finalized when one of the members of the group raised an objection that the land that we are looking to Purchase is in Vanikaran zone ( as per search report and 7/12 Extract) and his lawyer is saying that according to Forest Act of 1975, this kind of land cannot be purchased or sold whereas our legal counselors have said that there is no problem is such a purchase except that the FSI is only 0.4. We are looking to purchase 4-5 plots of 11000 sqft each in the scheme.

Since we are stuck with this problem, our group member says that he is willing to go ahead if there is some documentation which clearly says that Purchase and Sale of such land is permissible by law. Because of him others in the group are also asking for the same.

Our lawyers have not been able to help us in this regard though they maintain we can go ahead with the purchase. I tried to find information on the same online but couldn't find anything.

Appreciate if you could help throw light on the matter stated above and help us on the above issue with your expert advice.

I own a land about 5 acres in Dahuli maval district and I was wondering about constructing a farm house . I was also thinking it as I can use that farmhouse in order to rent out . So will be there any issues regarding it?

Hi. There is no restriction to buy or sell Vanikaran Zone lands.Generally areas around big Dams and thick forest areas are declared as Vanikaran Zone because the Govt does not want big constructions to come up in the area to avoid water pollution and protecting the environment. You can build a small farm house, Plant trees , do agricultural activities including Goat farming, Poultry, Cattle sheds etc.
This is applicable only to areas under Vanikaran Zones. If the saat baara extract shows Van written in the other rights of the saat baara, then you have to take prior permission from the Forest Department before buying or selling that particular land.

HI Gamut Infra,

I wonder if you got that resolved. I am in the same boat at the moment and have got vague answers and it is confusing.
Some experts in the zone say it is allowed to build a house but some are saying the Registration of Documentation is also not allowed.

I would request to seek your guidance on the same. How did you resolve the issue.

However collector may grant permission for transfer under the below mentioned conditions: a) Such a person bona fide requires the land for a non agricultural purposes or

b) The land is required for the benefit of an industrial or commercial undertaking or an educational or charitable institution or

c) Such land being mortgaged, mortgage has obtained from collector a certificate that he intends to take the profession of an agriculturist and agrees to cultivate the land personally or

d) The land is required by co-op society or

e) The land is required for cultivating it by a personally by a person, who, not being an agriculturist, intends to take to the profession of agriculture and to whom collector has given certificate that such person is intend to take to the profession of agriculture and is capable of cultivating land personally or

f) Such land is being sold in execution of decree of a civil court, or recovering arrear of land revenue.

In maharashtra only an agrculturist can purchase agricultural land. If you desire to purcase agricultural land you will need prior permission of collector.

Transfer to non agriculturist barred under Section 63

No sale, gifts, exchange or lease of any land shall be valid in favour of person who is not an agriculturist.
