Why CMDA or DTCP or GO approvals are very much neccesary while buying a property in chennai?

Hi Guys,
Like Chandra said , some time it depends on area. I will comment that , DTCP is the town and country planning authority, it is vested with the powers to approve any building plans and layouts. Panchayat does not have the power to approve any layouts. Patta is an extract issued by the register of land holdings maintained usually at the office of the concerned Tehsildar.

In my point of view, panchyat approval is also necessary . It is absolutely essential as it is the primary document which establishes the lawful possession and which also carries details about the extent of the property and its measurements. This is issued in the name of the person or persons in whose name the records relating to the holdings are maintained or may be available. The issuance of Patta signifies the lawful possession.

The DTCP is responsible for carrying out developmental activities on lands and buildings in Tamil Nadu, with the exception of municipal areas in Chennai. The area within the Chennai Corporation comes under the nodal Chennai Municipal Development Authority,(CMDA), formerly known as MMDA. The approval from DTCP or CMDA carries the benefit of owning land which can be used for the specific purpose it is designated for by the planning authority.

In my point of view, the major benefit of getting approval from DTCP or CMDA is the entitlement of getting building approval. This can be an assurance that the building cannot be demolished without proper procedure laid out for approved layouts.

Hi Mr Alex,
According to me, GO is the Government Order from the State Government which is the final order approving the application. Usually, GO is issued after the CMDA or DTCP approves the building plan. Having a GO approval but not a CMDA approval is a rare case. In such cases GO will only be released subject to permission from CMDA.

Hi Alex,
CMDA approval will be held where CMDA sees some issues related to land or lack of some statutory approval. For example, NOC from the Airport Authority or NOC from the Archaeological Survey of India. Normally, buyers wait for the CMDA approval before making any purchasing decision.

The procedure for getting approval for plotted development and apartments varies. In Chennai, the general path is that one has to submit the application with the required forms and documents along with the defined fee to the local body, which in turn forwards it to the regional office or the composite local planning authority, as applicable.

As per my knowledge, approvals are very much necessary. sometimes it depends upon the area . But CMDA, DTCP, TNHB approvals are very much essential in chennai. Before buying any property be sure that property has approval from any of the above said authority.
The respective scrutiny body then advises the applicant of the outcome. If successful, the applicant has to pay the required fee to get the approval. The government then issues an order to formalist this approval.

@ Alex,
As per the guiding principle, there is no minimum or maximum requirement of the area of a property to get DTCP approval. What is important is that the land should be within the limit of DTCP and must fulfill the norms prescribed by them.
According to me, any property with out any authority approval is meaning less, that property can be smashed to ground anytime by authority .
