Removal of non load bearing walls

Q: We are getting ready to purchase a flat in chennai. Spoke with the builders project team and engineering department regarding removing 2 walls in the kitchen . Builder and engineering team agreed it was perfectly fine .
However the HOA is refusing permission .
Is this legal .
It will not affect the building at all .
