Allahabad High Court issued a showcause notice to GDA,regarding land diversion in Ghaziabad.

Hi Mr Khan,
I heard in the news that, a probe against GDA officials, who had in the past arbitrarily changed land-use pattern of the city as earmarked in its Master Plan 2021, thereby leading to shrinkage of public spaces, has also been sought by the federation in its petition.

Hi Mr Khan,

As per different sources, the next date of hearing of the case has been fixed for February 12. In the PIL filed in December, the federation had demanded that the high court issue immediate directions for halting construction work underway in land reserved for community facilities in Indirapuram.

In my point of view, the federation had highlighted three instances of arbitrary land use change from Indirapuram area alone, where plots earmarked for community facilities were diverted to residential or residential-cum-commercial use by the GDA. The residents had also demanded the development of social infrastructure like schools, playgrounds, government hospitals and libraries in Indirapuram.

As per my knowledge, the Allahabad high court has asked the Ghaziabad Development Authority (GDA) to explain why land earmarked for community facilities and social infrastructure in the city has been diverted for other purposes.

A two-judge bench, comprising Chief Justice DY Chandrachud and Justice Suneet Kumar, on Monday issued a showcause notice to the GDA in the wake of a public interest litigation filed by the federation of associations of apartment owners (FedAoA) of Ghaziabad. The court has asked the GDA to file its response by February 9.

According to me, since the petition raises an issue of public importance relating to the use of land earmarked for developing community facilities and social infrastructure, we direct the third respondent (GDA) to file its counter affidavit by 9 February 2015
