The draft rule also makes it mandatory for builders to use units and symbols of measurements prescribed in Legal Metrology Rules 2011. No weighing or measuring instruments except those specified by Legal Metrology Rules 2011 shall be used for measurements. Such instruments shall be periodically verified as required under the new Act.
It s also notable that now builders can't advertise apartments in terms of square feet as has been the standard practice in the construction industry.

According to this new rules, carpet area of property must be mentioned along with a detailed plan with dimensions in sale, conveyance deed, lease deed or any other documents relating to transfer of property. The carpet area is measured by its length and breadth from plastered wall to plastered wall. All structural projections like columns that form shelves and make up for measurable area are included in the measurable area. Toilets and bathroom areas with tiled cladding shall have length and breadth measured from tile surface to tile surface.
You mean to say that now in every transaction of transfer of property, the actual area of property sold, delivered or transferred must correspond to the area as mentioned in legal documents. If the purchaser demands physical measurements of area or dimensions of property concerned, the seller or his representative shall be bound to fulfil such demand.
After getting approval by the concerned dept. a person cheated by a developer in terms of area or dimension of the property can make an application to the authorised officer to measure it and take legal action against the defaulter. The draft proposes penalties including fines and jail terms for repeat offenses.
Really Neeraj, Then it will surely control unfair trade practices and provide right delivery of area to consumers in terms of measurement and sale of usable/leased area. It was the first time in the country that such rules have been framed to save buyers.
