How to find your flat is yours and not sold to some one else?

Q: I've booked flat from a reputed builder. Agreement is done. But on one occasion i was being given receipt for amount paid by someone else. As per builder it happened because of similarity in name. But now in demand letter amount shown as paid by me doesn't match actual amount. How can i find that this is not the case where same flat is sold to two people?

Another way is, if you want to doubly sure and safe you can also give public notice in any two local news paper(one local language is compulsory) stating that you are planning to buy so and so properties, if any one has any rights or claim they should contact your lawyer in 15 or 20 days (give your lawyer number in the add). after 15-20 days if there is no claim, your lawyer will give a certificate. By this you can safeguard your self from any future issues.

you can always check with title search report. title search report will be issued after getting the confirmation from the sub registrar office. in sub registar office it will be checked, that any sale agreement on particular flat is registered with someone else or not.

Hi Jason,
To know the truth, verify if the building in which you are looking to buy has got a valid occupation certificate.

Otherwise, if you think that builder sold the property to two person by way of registration. If two sale deeds(or any document) are executed and registered for the same property, it is the document which was executed first shall be given effect to supposing that no registration was required says section 47 of the Indian Registration Act.
